What are the Convention’s main shortcomings? It allows States to exclude all AI systems designed, developed or deployed for the protection of national security interests from its application. Furthermore, the Convention fails to include the preservation of health and the environment as one of the general principles underpinning the activities within the lifecycle of AI systems. Overall, the Convention introduces imprecise language on States’ obligations that raises serious questions about their legal certainty and concerns about their enforceability and effectiveness.

May 17th, 2024, marks a historic milestone in the regulation of artificial intelligence as the Committee of Ministers of the Council of Europe adopts the first legally binding global instrument on AI systems. The Framework Convention on Artificial Intelligence and Human Rights, Democracy, and the Rule of Law will be open for signature on 5th September 2024. Negotiated with extensive international participation, the Convention is expected to attract many signatory countries not limited to the Council of Europe members. 🔥AI Treaty🔥 The Council of Europe #Committee on Artificial Intelligence yesterday finalised the Framework Convention on Artificial Intelligence, Human Rights, Democracy and the Rule of Law. The draft text will be referred to the Committee of Ministers for adoption and opened for signature at a later stage. According to a statement by Secretary-General Marija Pejčinović Burić on the occasion of the finalisation of the Convention: "This first-of-a-kind treaty will ensure that the rise of Artificial Intelligence upholds the Council of Europe's legal standards in human rights, democracy and the rule of law. 🗣️Yesterday, our Senior Policy Officer Milla Vidina delivered a statement of concern at the Last Plenary Session of Council of Europe’s Committee on Artificial Intelligence right after the Committee unveiled the final text #CoE Convention on #ArtificialIntelligence, #HumanRights, #Democracy and the #RuleofLaw. This Framework Convention is the world’s first binding legal instrument on AI with a dedicated focus on human rights, democracy and the rule of law. Equinet supported the concerns raised by Nele Roekens, Chair of the European Network of National Human Rights Institutions' (ENNHRI) Working Group on Artificial Intelligence on behalf of ENNHRI. We welcome the commitment of the Drafting Group to conclude the negotiations. However, we regret that critical safeguards were not included in the final text: 1️⃣ Oversight over all private sector activities within the lifecycle of AI systems. 2️⃣ Not allowing broad national security-based derogations. 3️⃣ Clear and strong safeguards on bans. 4️⃣ Independent oversight at both European and national levels. The Council of Europe adopts Framework Convention on Artificial Intelligence, Human Rights, Democracy and the Rule of Law. It will be a global instrument, open to the world. The text will be referred to the Committee of Ministers for adoption and opened for signature at a later stage. It will be open to all like-minded States wishing to uphold Council of Europe standards and values. After almost 2 years of intense negotiations, the Committee on Artificial Intelligence (CAI) of the Council of Europe approved the first global, legally binding treaty on #artificialintelligence, #humanrights, #democracy and the #ruleoflaw. The Committee is now elaborating a Methodology for the Risk and Impact Assessment of AI Systems on Human Rights, Democracy and Rule of Law (HUDERIA). This groundbreaking instrument was negotiated by the 46 member States of the Council of Europe - as well as 10+ like-minded partners including the United States, Australia, Canada, Japan, Mexico - and involved 70+ civil society organisations, industry representatives and relevant international organisations with a mandate on AI. While this treaty has been elaborated by the Council of Europe with like-minded international partners, it will be a global instrument, open to the world. After its adoption by the Council of Europe’s Committee of Ministers in the coming weeks, countries from all over the world will be eligible to join it and meet the high ethical standards it sets. https://lnkd.in/eJU9PvrK
