I'm not surprised to see this ban on AI-enhanced video evidence. We at Alitigate LLC have used just about every tool out there to experiment with AI in our legal video and trial support workflows. You've likely come across tools designed for upscaling photos or videos, and while these tools can produce visually stunning results, the devil lies in the details of how AI visual enhancement technically functions. AI image and video generators use a diffusion model to create their output. This means that AI essentially redraws your picture or video from memory, pixel-by-pixel. This process generates entirely new pixels for every single pixel in the original picture or video. Although that's great for entertainment, it presents significant challenges when using such AI-enhanced videos as evidence in legal proceedings. As AI technology continues to integrate with the legal sector, we legal professionals must carefully consider the implications of admitting AI-generated content as evidence. In the coming years, we'll see a lot of movement in this space as guidelines emerge to ensure the integrity of the justice system in the wake of AI proliferation.
