A $11.8m (USD) payment through a settlement agreement by an engineering firm this week was very disappointing for profession, but a great lesson learnt and reminder for all executives of engineering & construction firms on importance of having embedded enterprise risk management practices (across risk, compliance, business resilience, audit / assurance and projects), supported by organisation's culture and individual's engineering due diligence! (the role, domain and required competencies of CRO's in E&C organisations is definitely changing) Following US Hurricane Katrina in 2005, Federal Emergency Management Agency (FEMA) provided some asset owners with Public Assistance (PA) program funds for the repair or replacement of damaged facilities. A number of engineering firms were engaged under Technical Assistance Contracts, being responsible for conducting site evaluations and preparing and reviewing damage and repair cost estimates used to determine whether applicants were eligible for PA program funds. In particular, they were responsible for providing FEMA with truthful and accurate information regarding each facility’s pre-disaster design and all damage resulting from Hurricane Katrina. TAC's employees were assigned to prepare Project Worksheets on behalf of asset owners. PWs included damage descriptions and dimensions, scope of work, and estimate of the cost to repair damage and an estimate of the cost to replace the entire structure to its pre-disaster design. Asset owner was eligible to receive funds to replace the structure if the estimated cost to repair the structure after Hurricane Katrina was more than 50% of the estimated cost to the replace the structure. The lawsuit alleges that this engineering firm knowingly submitted false claims on behalf of asset owners seeking PA program funds, including by using inflated cost estimates and other false information, also falsely certified the accuracy of the information, AND awareness of its management of systemic problems concerning the provision of false and inaccurate information to FEMA BUT failed to notify the government! These tasks must be completed on time to prevent delays in project completion. 2. Prioritize Critical Path Activities: Focus on completing critical path activities during periods of dry weather to ensure they stay on schedule. Allocate resources and manpower accordingly to prioritize these tasks. 3. Utilize Float Time: Identify non-critical path activities that have float time or flexibility in their schedules. During heavy rain periods, allocate resources to these tasks, taking advantage of their flexibility to minimize the impact on critical path activities. 4. Overlap Tasks: Look for opportunities to overlap tasks where possible. For example, while waiting for heavy rain to subside, crews can focus on preparatory work for upcoming critical path activities, such as site preparation or material delivery. 5. Implement Acceleration Measures: Consider implementing acceleration measures such as adding extra shifts, increasing manpower, or utilizing specialized equipment to expedite critical path activities during periods of favorable weather. 6. Communicate and Coordinate: Maintain open communication with project stakeholders, subcontractors, and suppliers to ensure everyone is aware of the rescheduled work program. Coordinate closely to optimize resource allocation and minimize disruptions. 7. Monitor and Adjust: Continuously monitor weather forecasts and project progress to identify any potential impacts on the rescheduled work program.
