Also, ROs get the following: "On or before December 29, 2023, Defendants shall authorize all ROD licensees to open their first co-located adult-use dispensary." "On June 29, 2024 or as soon thereafter as practicable, Defendants shall authorize all ROD licenses to open their second and third co-located adult-use dispensary." "Defendants shall extend "site protection" to the three retail locations that each R.O. intends to co-locate."

As the licensed New York cannabis market continues to ramp up, it appears that a few of the entrepreneurs taking part have also been trying to take advantage of the successes earned by brands from other states. Case in point: One of the conditional adult use retail dispensary permit winners that was just denied for final licensure by the New York Cannabis Control Board listed its business name as Simply Pure LLC. It’s a solid brand name – and one that was made famous by Colorado cannabis queenpin Wanda James, one of the first and most high-profile Black entrepreneurs in the legal marijuana world. However, James , who also happens to be a University of Colorado regent, never gave her permission for anyone in New York to use it. James isn’t alone. There’s at least one other similar case of brand name appropriation in New York, this one by Ithaca-based Glass House Farms. In principle, legal weed saves lives, because weed is a part of people's lives. They will get it, legal or not, so it's either from the legal or illegal market. And despite the fact that there are many financial and regulatory challenges facing legal cannabis, the industry grows on. And every time someone switches from street weed to legal weed, that is another person who is exposed to a safer, healthier environment. And a safer product. This protects young and old alike, and keeps people out of trouble. Every licensed dispensary or delivery sale is a move towards that safety. Every tested jar, joint, gel, gram, etc.... all of it is an improvement. All of it is a step in the right direction. #BlocktheBans - we did it again! This time in #federal U.S. District Court. The recent #Arkansas law, Act 629, which purported to make hemp-derived #cannabinoids like #Delta8 illegal (but actually derailed the entire state hemp program), has been #enjoined after the Judge granted our request for a Temporary Injunction, based (in part) on the following: 🌱 Conflict #Preemption: the State's change to the definition of #hemp from the federal definition would likely be preempted by the #2018FarmBill due to the #conflict between the two. 🌱 Express Preemption: interference with #interstate transportation is expressly preempted by the 2018 Farm Bill explicit protection of #interstatecommerce 🌱 Void for #Vagueness: right from the Judge - "Act 629 contains terms that would confuse even an exceptionally intelligent reader. Specifically, “continuous transportation”, “synthetic substance”, and “psychoactive substances” are vague, and are not defined in the statute." Trial is set for August 27, 2024 (but if the State appeals the Temporary Injunction, we may be in for a ride before then). Excellent and thorough article Mona Zhang for providing the backdrop and current legislative status of desperately-needed civil enforcement laws to prevent NY's market from mimicking CA's industry. And thank you Jeremy Cooney for enabling this industry to be more competitive and efficient through all your support. Lastly, Ruben Lindo and I finally agree that more licensed retailers are needed to provide access and let consumers do the right thing. So much energy and attention focused on NYS getting this right -- so exciting! And regarding how NOT to launch a newborn industry: (1) do NOT waste precious time by involving unhelpful government agencies like DASNY that would only sandbag the project; (2) DO properly fund the licensing agency so that there are more than 32 application reviewers to handle thousands of applications; (3) DO have competent Attorney General lawyers represent State interests in Article 78 litigation AND competent judiciary to adjudge such lawsuits; and, (4) for law enforcement, DO use long-standing doctrine of plain sight for civil enforcement of unlicensed dispensaries.
