On July 9, 2024, the U.S. Forced Labor Enforcement Task Force designated aluminum, poly-vinyl chloride and seafood as a high-priority sector under the Uyghur Forced Labor Prevention Act, or the UFLPA. The UFLPA prohibits any materials was sourced, in whole or in part, with forced labor or from the Xinjiang region of China. CBP has authority to detain or reject such shipments and to institute financial penalties against the importer of record up to the value of the shipment. U.S. importers should consider taking additional steps to evaluate company supply chains in light of these the new priority enforcement areas.

The House Select Committee on the Chinese Communist Party recently sent a letter to Department of Homeland Security Secretary Alejandro Mayorkas regarding strengthening enforcement of the Uyghur Forced Labor Prevention Act. The UFLPA establishes a rebuttable presumption that goods produced in whole or in part in the Xinjiang Uyghur Autonomous Region of China, or by specific named entities, involve forced labor and therefore cannot be imported into the United States pursuant to Section 307 of the U.S. Tariff Act. On July 9th, the Department of Homeland Security (DHS), as chair of the Forced Labor Enforcement Task Force (FLETF), released its updated Uyghur Forced Labor Prevention Act (UFLPA) Strategy. Among other things, it identifies new high priority sectors for enforcement – aluminum, polyvinyl chloride (PVC), and seafood. The FLETF continues to designate apparel, cotton and cotton products, silica-based products including polysilicon, and tomatoes and downstream products as high priority sectors. Other products not designated as “high priority” continue to be detained under the UFLPA. The Forced Labor Enforcement Task Force, chaired by the U.S. Department of Homeland Security and with crucial input from ILAB as a key member, just announced the first steel and aspartame companies to be added to the #UFLPA Entity List, bringing the total number of entities on that list to 75.
