Section 45 of the Constitution is clear on the point that the fundamental right to freedom of expression, or protest, can only be restricted by a law that is reasonably justifiable in a democratic society in the interest of public order and safety. An exparte order of a High Court is not “a law that is reasonably justifiable in a democratic society”. Such an order cannot therefore legitimately restrict a fundamental right to protest. The exparte court orders obtained by the Attorneys-General of Lagos State and of the Federation underscore three things we already know or should know: 1. There’s a difference between a civilian government (civilian rule as opposed to military rule), and a democratic government. 2. A civilian government is not necessarily a democracy. It can still be a dictatorship. 3. The pronouncements of a Court of law can deliberately and subtly be made in aid of a civilian government which is in fact a dictatorship. #EndbadGovernanceInNigeria

Kosovo has signed the 2005 Choice of Court and 2019 Judgments Conventions! The Conventions will enter into force for Kosovo only after it deposits instruments of ratification pursuant to Art. 31(2) of the 2005 Choice of Court Convention and to Art. 28(2) of the 2019 Judgments Convention. The 2005 Choice of Court Convention currently binds 35 States and the European Union. As for the 2019 Judgments Convention, there are currently 30 HCCH Members that are either bound by it or a Contracting Party for which it has not yet entered into force yet (the United Kingdom and Uruguay). The law points/ public importance are; Whether constitutional amendments can be challenged before Hon’ble court under light of District Bar Assiciation case. Whether seperation of power is a principle which cannot be amended. Whether principles laid down in the case of Al Jehad Trust and Asad Ali and enshrined under s.175 A of the Constitution can be interfered through constitutional amendment. In nutshell, this amendment is attack on the constitution by the unscrupulous kind of establishment. It’s duty of legal fraternity to protect the constitution at all costs, and to stand firmly against military tyranny.

Awaam Pakistan convener and former prime minister Shahid Khaqan Abbasi filed a petition in the Sindh High Court (SHC) on Monday, challenging the 26th Constitutional Amendment. In his petition, Abbasi argued that the amendment was passed through a “grossly defective legislative process” and called for it to be struck down, claiming it violates the Constitution's salient features, including the independence of the judiciary, federalism, and the trichotomy of powers. In the darkness of nights looters loot the people. But there is a countries where the parliament passes the laws. The current 26 amendments in constitution are passed in the nights. So, we can say the amendments are the other name of robbery on the court. According the amendments: "A special commite of national assembly and senate will nominate the name of Chief Justice of supreme court with the 2/3 majority from the list of 3 judge". Supreme court will hear only routine matter cases ( disputes of property or public interest cases). All the constitutional and political issues will be hear in Constitutional Bench. This bench head will be a judge of supreme court. There will be 5 judges in this bench. So, it's mean supreme court has loss it's value. The judges will be appoint indirectly by the government. Those judges who will make judgements on the wish of government they can be make Chief Justice. But don't disappoint there are many good people in the system. He said, “I’m a civilian, not a soldier—let the civil courts do their job!” And guess what? The Constitutional Court agreed! 🏛️ The court ruled that trying civilians in military courts violates our Constitution, especially the right to a fair trial and Judicial Independence-calling on the usual words ‘Impartial and Independent Courts/Tribunals’ (shoutout to UG Constitution of 1995 Articles 28, 44, 126, 128, 137, 210!).
