Unlike, for example the USA, divorce in Australia is what we call a ‘no-fault’ system. This means the Court is not concerned with who may have caused a relationship breakdown but rather, they only require that there is an irretrievable breakdown of the marriage. Once the requirements for applying for divorce have been met, the process is generally relatively simple.
