01.07.2024 Inaugurazione a Milano della Sede Centrale TUB (Tribunale Unificato Brevetti)   Il 1 Luglio 2024 è stata finalmente inaugurata a Milano la Sede Centrale del TUB (Tribunale Unificato dei Brevetti).   Inizialmente le 3 Sedi Centrali del TUB erano a Londra – Parigi – Monaco di Baviera.   Come conseguenza della Brexit, Milano è riuscita ad ottenere l’aggiudicazione della sede di Londra del TUB, per alcune specifiche materie.     Oltre alle 3 Sedi Centrali del TUB, esistono anche diverse Divisioni Locali e Regionali in Europa, che sono distribuite nei vari Stati membri. Milano aveva già una Divisione Locale operativa nel Palazzo di via San Barnaba 50, alla quale si è potuta aggiungere la Sede Centrale, che è competente per le cause più complesse.   Le competenze assegnate alla Sede Centrale del TUB di Milano sono i contenziosi dei brevetti riguardanti le “Human Necessities” (nello specifico i preparati medicali, abbigliamento, calzature, arredamento e settore agroalimentare).   I giudici dei TUB non sono solo “puri giuristi” (togati) ma anche giudici tecnici, ovvero consulenti in Proprietà Industriale, al fine di poter assicurare un’ampia e precisa conoscenza degli aspetti tecnici delle controversie. Inoltre, i giudici dei TUB provengono da vari Stati membri dell'UE, rappresentando così la diversità giuridica e culturale dell'Unione Europea.   Avere ottenuto l’aggiudicazione della nuova Sede Centrale del TUB a Milano (grazie al profuso impegno professionale della Commissione dei Rapporti Internazionali degli Avvocati di Milano) rappresenta una grande conquista ed opportunità per l’Italia.   Questo considerando che non solo società aventi sede in Europa (incluse quelle radicate in Lombardia, con trend decisamente crescente), ma anche un consistente numero di società americane e cinesi stanno richiedendo Brevetti Unitari, approfittando così della semplificazione amministrativa e convenienza economica di ottenere una copertura europea con una sola domanda di brevetto: il Brevetto Unitario!   Lo studio DM&P Legal & Tax è a disposizione per approfondimenti. #TUB
