🏢 A commercial lease is the foundation under which so many businesses operate.
🤝 It is the legally binding agreement between a commercial landlord and business tenant, that provides security of tenure.
⏰ Whether it’s 3 years or 25 years, eventually the fixed term of the tenancy will expire.
✔ It’s important to understand your rights and obligations when it comes to correctly ending or renewing the commercial lease and when court proceedings might be needed.

Jurak v Latham [2023] NSWSC 1318 involved a family provision claim by a child of the late Josef Jurak. The Court emphasised the need for practitioners to bring attention to matters where affected persons may not have been notified or if there are doubts about exercising jurisdiction. The Court also discussed specific aspects of family provision claims, including procedural requirements and the making of consent orders.
“The sheer volume of matters which are filed in or allocated to the Succession & Probate List and, in particular, the volume of matters in which practitioners seek consent orders invoking jurisdiction under the Succession Act 2006 (NSW) necessarily has the effect that the Succession & Probate List Judges are heavily reliant upon practitioners not merely providing proposed orders in an orderly form but, additionally, specifically reliant upon practitioners being vigilant to drawing to the attention of the judges matters in which there is some question regarding whether persons who are or might be affected have been notified, any matters occasioning doubt about the exercise of the jurisdiction and any other unusual aspects attending the matter.” at [14]).
I recently co-authored an article on Jurak v Latham which was published in the NSW Bar News Autumn Edition. Jurak v Latham was one of Meek J's most impactful decisions of 2023 because it reinforced the importance of procedure in estate litigation. Our article is available for download now on Austlii or you can grab it here. For those of you who have not met my learned co-author, Michael Morgan is one of our newer floor members at 13th Floor St James Hall and was briefed to appear in Jurak v Latham. Michael was called to the Bar in 2022. He conducts a general commercial and equity practice and also lectures at Western Sydney University. For all enquiries regarding Michael or myself, please contact our Clerk, Eugenie Crosby, on (02) 9335 3000 or email clerk@13stjames.net.au#estatelitigation#sydneybarrister#succession

Hot off the press! Westfair Business Journal reported on FLB Law's annual Real Estate Outlook. The article, featured on the inside cover of the digital publication, provides a detailed overview of the morning's roundtable discussion. Held at the M&T Ban Magnificent Room at The SoNo Collection, the Real Estate Outlook attracted over 100 attendees from various segments of the market.
FLB Law Managing Partner Eric Bernheim opened the event with a powerful analogy: “If you visualize the real estate market as a rope, each strand of that rope really needs to be strong enough so that the entire market is strong. In order to have a strong residential market, you need to have retail and commercial to support that; without any one component, the other two are under that much more strain."

In this article we look into Martelli v Liow [2024] NZHC 968, a recent High Court decision on cross leases. High Court decisions in this space are rare as most cross lease disputes are resolved through arbitration. This case arguably makes it easier to develop/renovate a cross lease property and get the consent of your neighbour. Thanks to our Legal Assistant Taric Speir for helping out with drafting the article and the appellant Brett Martelli for chasing justice.
