Justice and Civility in Post-Disaster Litigation In the aftermath of a natural disaster like Hurricane Helene, the lives of many—lawyers, witnesses, and litigants alike—are deeply disrupted. Coastal communities face significant challenges, making the litigation process increasingly difficult. The logistical hurdles of empaneling juries and coordinating schedules become monumental as both the legal system and affected individuals struggle to regain a sense of normalcy. In these trying times, it is crucial for lawyers to remember the oath we took upon entering this noble profession. We pledged to uphold fairness, integrity, and civility, even in the most difficult circumstances. This is not just a formality but a guiding principle, especially when the pressures of disaster magnify tensions. Opposing parties and their counsel deserve respect and patience, even when the emotional toll is high. Refraining from offensive or abrasive conduct becomes essential as we navigate the inevitable complexities of post-disaster litigation. As attorneys, our role extends beyond advocacy—we are also custodians of justice and decorum. In moments of hardship, maintaining professionalism and respect is vital. You never know what personal challenges the other side may be facing, so I urge you to approach each interaction with kindness and understanding.

𝗖𝗼𝗮𝘀𝘁𝘀 𝗶𝗻 𝗖𝗼𝘂𝗿𝘁: 𝗪𝗮𝘁𝗰𝗵 𝗳𝗼𝗿 𝗪𝗮𝘃𝗲𝘀 𝗼𝗳 𝗟𝗶𝘁𝗶𝗴𝗮𝘁𝗶𝗼𝗻 Rising sea levels and collapsing coastlines are pushing states and cities to act—but when they do, they're finding themselves in court. Last year, a resident near the North Sea sued the UK government for failing to protect his community from flooding. In the U.S., we're seeing similar legal challenges whenever states redraw beachfront property lines, or cities refuse to let private landowners build seawalls. The Pacific Legal Foundation (PLF), a libertarian group, is often behind these lawsuits. PLF argues that property rights should be as protected as free speech or religious freedom. They want federal courts to treat land use regulations as violations of constitutional rights. Their success is growing. PLF has doubled in size since 2016 and is filing more cases than ever. Just this past year, they helped to limit the government's authority under the Clean Water Act—and they're not stopping there. PLF is fighting to ensure that even local land use regulations go straight to federal courts, bypassing state-level protections and reviews. This means that as sea levels rise, legal battles over coastal regulations will intensify. Cities and states will face increasing hurdles as they try to protect their coastlines from flooding and erosion. We’re entering a new era of coastal litigation, and it's going to be a long, complex slog in the courts. The real question is whether the courts will protect public safety—or private property. The future of our coasts may well be decided by what happens in these courtrooms.
