If you want to substantiate a workplace policy violation, prove each element of it. It is never enough to make an investigation finding of “Bob stole the money.” Your investigation requires a more precise finding if you want to contribute value. You must satisfy the burden of proof for each element of the violation. There is a parallel here to criminal justice. For example, to convict a defendant of criminal fraud, a prosecutor must prove – beyond a reasonable doubt – each of the elements: (i) a misrepresentation to the company of a material fact; (ii) that was known to be false when said; (iii) that was intended to cause the company to rely on it; (iv) the company relied on it; and (v) the company suffered damages as a result. The prosecution must develop sufficient facts to substantiate each element by the requisite standard of proof. Each element must be proven. If one element cannot be proven – assume there was insufficient evidence of whether the misrepresented fact was “material” – the defendant goes free. In other words, the prosecutor is assembling evidence not to prove “fraud,” but to prove each of the five requisite elements. The same approach applies to workplace investigations. Consider your company policy prohibiting harassment. Even if not stated explicitly (it rarely is), the elements are (i) unwanted and offensive conduct, (ii) a reasonable colleague in the recipient’s position would also find it unwanted and offensive, and (iii) the conduct is part of a pattern or singularly egregious. Focusing on the requisite elements is essential to an efficient and effective investigation. The elements guide you to find the right evidence, to see if you met your burdens of proof and persuasion, and to structure the investigation report in a useful way. Let’s talk about investigations and interviews: As ex-cops we have investigated an abundance of crimes, complaints, policy violations, civil infractions, etc. We have also interviewed hundreds or thousands of people. Suspects, victims, witnesses, involved, not involved, etc. Every traffic stop or accident is an investigation and interview. A run-away complaint, death investigation, violent crime, burglary, fraud, the list goes on. This list may differ for those who came from smaller or larger agencies and depending on what part of the country you are from. From death notifications, to homicide suspects, to kidnap victims, to human traffickers, million dollar fraud scheme suspects, serial commercial burglars, cartel drug traffickers, victims of sexual assault, domestic violence, child abuse victims, just to name a few in my career. I’m confident that all cops can move into the corporate world and investigate any type of complaint and interview any person with thoroughness and an unbiased approach to find the truth. I would lean towards someone with such diverse experiences in so many different categories, regardless of a corporate certification or not. The experiences we have from real-life interactions with thousands of people, usually in some form of crisis, are unparalleled.
