🍷🍇 Sip on this… U.S. businesses selling “export property” (e.g. wine) and turning a profit can use IC-DISCs to reduce tax liability. Export property includes items made in the U.S., held for sale for use, consumption or disposition outside the country, with no more than 50% value from imports. Wineries selling wine abroad and wholesale distributors selling to international markets (including Canada & Mexico) can both benefit from IC-DISCs. The maker of Penfolds, Treasury Wine Estates is focused on the re-establishment of its Penfolds Australian portfolio in China following the removal of tariffs. SCOTCH WHISKY EXPORTS One of Scotland’s most important exports is whisky, and exports have soared in recent years amid growing demand for Scotch whisky in key markets such as the USA, France, Singapore, Taiwan, China and India. Distillers contributed £ 5.3 billion to the Scottish economy and £ 1.8 in the rest of the United Kingdom in 2022, according to the new report from the Scotch Whisky Association. Whisky production is the second most important industry, after energy, contributing three percent to the GDP. Mark Kent, CEO of the SWA, stated : ‘The Scotch whisky industry has once again proven its economic significance to the UK domestically and on the world stage, and these figures highlight the importance of backing a key sector for productivity, exports and employment.’ The industry has had a ‘turbulent’ five years, including the Covid-19 pandemic, Brexit and a trade battle between the UK and the USA. Yet, it has remained resilient with exports surging to £ 6.2 bn in the five years to December 31, 2022. However, the leaders of the industry warn that the sector faces significant headwinds as it seeks to maintain that growth in the years ahead. High taxes on spirits sales, a lack of infrastructure investment in Scotland and trade deals that still need to be finalized. Almost every country increases taxes on alcoholic beverages constantly to the detriment of employment and sales. Scotland is the most famous of all whisky-producing countries. Ireland, Japan, Taiwan, South Africa, France, China, India, the USA, Canada, and even Germany produce whisky but none has been able to come close to the flavour of Scotch whisky.

Under federal regulations, the consignment sales provisions of the FAA Act, 27 U.S.C. 205(d), make it unlawful for an industry member (such as a producer, importer, or wholesaler of malt beverages, wines, or distilled spirits) to sell, offer for sale, or contract to sell to any trade buyer (a wholesaler or retailer), or for a trade buyer to purchase, offer to purchase, or contract to purchase any products: (a) on consignment; or (b) under conditional sale; or (c) with privilege of return; or (d) on any basis other than a bona fide sale; or (e) where any part of the sale involves, directly or indirectly, the acquisition by the industry member of other products from the trade buyer or the agreement to accept other products from the trade buyer. Sales “on consignment,” as that term is used above, are arrangements in which the trade buyer (i.e., a wholesaler or retailer) is under no obligation to pay for distilled spirits, wine, or malt beverages until they are sold by the trade buyer.
