So this happened... I was working with a salesman for a month and he was just fired because he was taking orders from customers and selling them another vendors product out the back door. 🙆♂️ 🙅♂️ 😡 This is the type of stuff that illustrates the reason that non-compete agreements are so important for businesses. Below let me outline what I think is important for a non-compete. 👇 👇👇 When I write a non-compete, I am strictly looking to protect my interests and not be overly restrictive on the employee. Everyone has to work and the last thing you want to do is unreasonably prevent someone from working. 🔸 Limit the geography if they cover a territory. 🔸 Limit the buyers (for a salesperson) to only buyers who they sold for you. 🔸 Limit account restrictions to only accounts they sold for you. 🔸 Limit the restrictions to a limited number of companies who you consider highly competitive. 🔸Only use them in cases which you really have an interest to protect. For the most part, why would you need a non-compete from an employee who works in an administrative position. The primary function should be sales, product development, and people with knowledge of systems and processes that are unique to your company. In general, the goal is to put in place an agreement that would keep an honest person honest. You are never going to get a dishonest employee to act ethically. I had one employee in sales who I restricted to not working for 3 importers who I deemed competitive. The employee still went to work for one of those 3 companies. 🙅♂️

I received this text the day from a former colleague with my company. It made me think, WOW! I think I take for granted all the “goodies” my company does for our LOs, starting on the tech side (we have our Admins (2) to customize our Encompass) to Operations quick turn-times, O and our Marketing Department. Well, “goodies” are an understatement….
