On April 4, 2024, the US Citizenship and Immigration Services (USCIS) announced new guidance on the validity period of Form I-693 Medical Examinations that are required for Adjustment of Status (green card) applications. Medical examinations that were completed and signed by the USCIS-designated Civil Surgeon on or after November 1, 2023 no longer expire after two years, and are valid indefinitely as evidence to show that the adjustment of status applicant is not inadmissible on health-related grounds. Applicants whose medical examinations were completed and signed prior to November 1, 2023 will remain subject to the two-year validity period under the USCIS’ previous policy. Please note that the USCIS adjudicators have the discretion to request more evidence or a new or updated medical examination if they have reason to believe the applicant’s medical condition has changed since the civil surgeon signed the Form I-693, regardless of the validity period.

NAVIGATING MEDICAL EXAMS: UNDERSTANDING THE TYPES As mentioned in our earlier post this month, embarking on the immigration journey may involve medical exams, and understanding the types is key. Here's a glimpse into the two categories: 1. Standard Medical Exam: The standard medical exam is a comprehensive assessment conducted as part of the immigration process. It's a crucial step to ensure the health and well-being of applicants. 2. Streamlined Medical Exam: In certain urgent operational situations, such as humanitarian crises or other exceptional circumstances determined by IRCC, a streamlined medical exam may be requested. This simplified process is designed to address immediate needs. It's essential to note that applicants cannot request a specific type of medical exam. The type required will be communicated to you based on your circumstances. Choosing a Panel Physician: When it comes to medical exams, you must visit a doctor from the list of panel physicians. Your personal doctor cannot conduct the immigration medical exam. While the panel physician conducts the exam, the final decision lies with the IRCC. In case of any issues with the medical exam, they will communicate with you in writing. Understanding these distinctions ensures a smoother medical examination process as you navigate the immigration landscape. #CanadianImmigration #ImmigrationLaw #CanadaVisa

📢 Important Update for Form I-693 Validity Extension USCIS has made an announcement regarding the Form I-693, Report of Immigration Medical Examination and Vaccination Record. As of Nov. 1, 2023, any Form I-693 signed by a civil surgeon will no longer have an expiration date. This means that these forms can be used indefinitely to prove you are not inadmissible on health-related grounds. This change reflects advancements in public health electronic notification and consultation with the CDC. It's a big step forward in streamlining the immigration process! Remember, this applies only to forms signed on or after Nov. 1, 2023. Forms completed before this date still fall under the previous two-year validity period, except for Operation Allies Welcome parolees, whose forms are valid for three years. https://lnkd.in/e-GGanAm

Update: USCIS Policy Regarding Medical Exams on Form I-693 Important update from the U.S. Citizenship and Immigration Services (USCIS) regarding Form I-693, Report of Immigration Medical Examination and Vaccination Record! Effective November 1, 2023, any Form I-693 properly completed and signed by a civil surgeon does not expire and can be used indefinitely as evidence of an applicant's health status, eliminating the previous time limitations. This decision, made in consultation with the Centers for Disease Control and Prevention (CDC), reflects advancements in public health electronic notification. USCIS officers may still request additional evidence or an updated Form I-693 if there are concerns about changes in the applicant's medical condition since the form was signed or if the form does not accurately reflect the applicant's health status. For those whose medical examinations were completed before November 1, 2023, the previous policy applies, with the Form I-693 retaining evidentiary value for two years from the date of the civil surgeon's signature. Note that this exception does not apply to Forms I-693 filed by Operation Allies Welcome parolees, which retain evidentiary value for three years from the date of the civil surgeon's signature.
