For your viewing enjoyment, below is the striking pattern of the 22 states that joined an amicus brief advocating for the 11th Circuit to strike down the Corporate Transparency Act as unconstitutional. Only seven of those states rank in the top 22 in terms of number of small businesses (data from the Small Business Administration): Florida, Georgia, Missouri, Ohio, Tennessee, Texas and Virginia. Eleven of them rank in the bottom 22 states in terms of number of small businesses. I don't mean to dismiss the interests of businesses in those states. Collectively, they represent approximately 40% of American businesses with fewer than 20 employees (meaning none of them would qualify for the CTA's large operating company exemption). But so do the small businesses in these 8 states (which also comprise approximately 40% of the nation's small businesses) none of which joined the amicus brief: California, New York, Illinois, Pennsylvania, New Jersey, North Carolina, Michigan and Washington. The recent Loper Bright Enterprises v. Raimondo overruled the Chevron deference doctrine, which gave federal agencies authority to interpret ambiguous statutes. Now there are greater demands for technical expertise in congress. Chevron deference, which directed courts to defer to agencies' interpretations of statutes when the text was vague or silent, empowered agencies to tackle complex regulatory issues. Without Chevron, Congress must legislate with greater specificity, necessitating an increase in its technical capacity. The author of a recent piece in The Hill, Maya Kornberg, makes an interesting argument - some analysis and my take below. The legislative branch currently lags behind the executive branch in funding and infrastructure, with the executive branch having more than 120 times the funding of Congress. This disparity has allowed the executive branch to employ the best experts and evidence, resulting in greater discretion in implementing laws. In a post-Chevron world, the author argues that Congress can no longer afford this reliance. The author argues that several steps can be taken to bolster congressional capacity. As noted in a recent paper by Martha Kinsella, creating a new Science and Technology Hub within the Government Accountability Office would be a significant move. This hub, staffed by technical experts, would help translate scientific information for Congress and connect members with advisory councils of outside experts, similar to the advisory committees in the executive branch and the National Academies of Sciences, Engineering, and Medicine. She also argues that Congress must invest in more skilled committee members and personal staff. Limited office budgets, caps on staff numbers, and the loss of over 1,000 committee positions in the last three decades have hampered Congress's ability to gain expertise on complex issues. Increasing personal office and committee staff budgets, utilizing the House HR hub for hiring staff with suitable backgrounds, and lifting the cap on personal office hiring are essential steps. I wholeheartedly agree that congress needs more technical staff and capabilities, but there has long been a fundamental shortage of skilled and technical workers in federal agencies as well (link below in the context of AI).
