The Levelling Up and Regeneration Act 2023 set out amendments to planning enforcement provisions within the Town and Country Planning Act 1990, and secondary legislation was finalised on 2nd April 2024 (see The Planning Act 2008 (Commencement No. 8) and Levelling-up and Regeneration Act 2023 (Commencement No. 4 and Transitional Provisions) Regulations 2024). Section 115 revokes the current four-year time limit for enforcement actions, increasing the time period in which local planning authorities can take enforcement action against unauthorised development in England to 10 years in all cases. This applies to operational development and change of use of any building to use as a single dwellinghouse. The new provisions came into force on 25th April 2024 The transitional provisions mean that this change will not apply in the following circumstances: Where the operational development was substantially completed before 25th April 2024; or Where the change of use to a dwelling occurred before 25th April 2024. Provided that the above criteria can be met, then the four-year rule would remain. Any property owners with a planning breach should be aware that the process of obtaining a Certificate of Lawfulness is complex to ensure compliance with the regulations and requirements. POLICY UPDATE: The Government is set to consult on National Development Management Policies (NDMPs) next year. The housing minister Matthew Pennycook MP says that it will then publish another ‘slimmed down’ National Planning Policy Framework (NPPF), which will be focused solely on plan-making. KPPC Planning Director Adam Bennett has set out what the implications for this could be and where issues may arise - including the primacy of national policy. New explanatory notes for the Area Plan North and West are available to help the public understand proposed changes in the draft plan. https://ow.ly/730250RNGEq The notes aim to help people to understand figures, calculations and other details in Public Inquiry Papers. The inquiry will be led by an independent Planning Inspector and is scheduled for July 2024. The document includes additional context on: 👉Public consultations by the Cabinet Office 👉Development site densities 👉Difference between gross site and net developable area 👉Potential development sites on the edge of Peel Since the Draft Plan was published in June 2022, a number of additional, potential development sites for housing and other uses have been submitted by a mixture of developers, landowners and Local Authorities. Water and critical housing infrastructure is vital to deliver new homes and address the housing crisis and yesterday we took action by accelerating $59m in water and sewer infrastructure upgrades in the northern suburbs to enable homes to be delivered as quickly as possible. The Malinauskas Labor Government is pleased to stand with the housing and construction industry associations who have raised serious concerns that, without action, building will stall and developers could abandon projects due to the inability to connect to water and sewerage. The decision will address a failure of the former Liberal Government. A prime example of what happens when governments prioritize short term politics over long term, strategic decision making.
