An effective litigator – for example, a prosecutor in a criminal court case – will often adopt a quiet, reserved, understated mien in the courtroom. The person in this role projects a sense of calm, while being in complete control. The prosecutor should be spare with words, making statements and putting questions to witnesses in succinct language, uttered in a moderate-to-slow pace, never showing emotion, and always in complete control of the pace and delivery of evidence toward building an airtight case. This is the manner adopted by the Congressional January 6 Committee.  Although the Committee had no authority to prosecute or convict, its final report is ready-made for the US Justice Department to seek indictments and proceed with criminal prosecutions.  This short (50 minutes) documentary is like the prosecutor I’ve described.  Neither the committee members nor their witnesses show much emotion – which, of course, could be due to careful editing – but it would make sense that the Committee and its witnesses shared a common cause of producing as objective a record as possible of what occurred on 6th January 2021. This documentary is jolting for at least two reasons: it cuts back and forth between the calm solemnity of a congressional inquiry and the brutal, hand-to-hand combat between an enraged mob and a woefully understaffed and inadequately armed capitol police force; but closer to the exposed nerve, it’s nearly impossible to get one’s head around the events themselves and their implications for the future of American democracy. Three years later (to the day), it still boggles the mind. Unless you are a member of the MAGA hard core – and if you are, you’re not likely to be reading this post – this brief documentary will disturb you profoundly.

This sobering programme illustrates just how ill-equipped humans are to draw reliable or accurate interpretations from interactions with other humans. All those who aspire to judicial office (and, dare I say, some who have already attained such office!) would benefit from this reminder that there is no fool-proof method of measuring honesty in a witness. What may appear to be hesitation or evasion may be attributable to simple nervousness.
