Florida’s legislature took a big step forward in solving the state’s housing affordability woes when it passed the Live Local Act in 2023.
One year since the bill became law, real estate developers are tapping into the new policy and fast-tracking the creation of higher quality affordable housing.

The Wall Street Journal gets it right in an Op-Ed published this week. With housing supply and affordability at historically-challenging levels policymakers should be encouraging and incentivizing new housing development and investment, not creating barriers that restrict the building of new homes and flow of needed capital.
“Against the backdrop of a national shortage of affordable housing, due in large part to government policies, California lawmakers want to restrict corporate investment in single-family rental properties. This would make the Golden State’s housing affordability crisis worse….[these] proposals would force financial capital out, reduce the future stock of rental housing and increase rental prices.”

The prospective housing deal in New York's budget, unsurprisingly, does not include any growth mandates. Leaving them out was likely necessary to get to any deal at all, but New York should not give up on the policy if it really wants to ramp up its housing supply. In our continuing series on the affordable housing levy (AHL), we compare the current situation to a game of chess, emphasizing the strategic moves and the administration's effectiveness in addressing the issues raised by the High Court.
We highlight the impressive turnaround time, from the High Court's declaration of AHL's unconstitutionality on 28th November 2023, to the tabling of the affordable housing bill (Bill) in Parliament on 7th December 2023, the commencement of public participation on 9th December 2023 to 28th December 2023, and the Bill's passage by Parliament on February 22nd 2024. We highlight the Senate's current consideration of the bill and the upcoming public submission process.
This timeline despite a case challenging the Bill's public participation which was thrown out and Parliament's recess from 8th December 2023 to 12th February 2024 which suggests that the reintroduction of the levy is imminent.

We also explore the contentious transfer tax initiative among other risks facing property owners, including energy policies and strategies to enhance housing affordability, aiming to draw both people and businesses back to Massachusetts.
