There is mixed feedback regarding nursing homes staffing mandates. I thought this was an interesting new mandate which nursing homes resident advocates will welcome. It will require thousands of nursing homes hire more nurses and aides and it will give them years to accomplish this. The American Health Care Association thinks this is unreasonable and a nearly impossible task for nursing home providers, because of the ongoing worker shortage nationwide. The nursing unions welcome this new a mandate. It is agreed that it is challenging to find enough people to work in nursing homes when there is a 3-4% unemployment rate. This article presents recent stats on agency staffing at nursing homes. A key stat: "By 2022, almost 35% of nursing homes were using agency staff every day. This is a clear sign there is a shortage in the availability of workers.”

Nursing home operators are pushing Congress to block a new rule ensuring adequate staffing for patients. The rule requires all nursing homes to: ✅ Provide at least 3.48 hours of nursing care per resident per day ✅ Have a registered nurse available around the clock One of the nation’s biggest nursing home trade groups is fighting these needed changes and is now asking Congress to overturn the rule. They claim that a "worker shortage" is preventing them from meeting the new staffing standard, but our analysis shows that isn't true. Instead of trying to overturn a rule that helps protect both patients and workers, nursing home operators should improve pay and working conditions to attract and retain the staff they need. Health Affairs' nursing home staffing study examines trends in the use of staffing agencies among nursing homes during the prepandemic and COVID-19 pandemic era. Agency staff were increasingly used to address chronic staffing shortages. "Agency staff were 50–60 percent more expensive per hour than directly employed nursing staff, and nursing homes that used agency staff often had lower five-star ratings. Policy makers need to consider postpandemic changes to the nursing home workforce as part of nursing home reform, as increased reliance on agency staff may reduce the financial resources available to increase nursing staff levels and improve the quality of care." “Nursing home operators strongly objected to the minimum staffing proposal in September, saying they already struggle to fill open positions. Such a requirement could force some facilities to close.” Exploding long-term care costs represent a gathering storm for the economy. Nursing homes, in-home health aides, skilled nursing facilities are in short supply and high demand. There simply are not enough professionals or facilities to meet the need. Average stays at these facilities - even in the Midwest - are pushing $10,000 per month. If retirees don’t have this monthly, after-tax income accounted for, then it can quickly exhaust even the most well-planned nest egg.

Nursing a health staffing shortage. Yet the Biden administration insists nursing homes shouldn’t fear a new staffing rule, pointing to exemptions and more time to comply. “There is just not a registered nurse to be found,” administrator Paul Treffert, CEO of the 85-bed nonprofit home Sheboygan Senior Community in Wisconsin, told Robert. “Mandate whatever you want, pay whatever you choose, they are just not there.” The scale of the nursing shortage could impact whether the rule achieves its goal of improving quality in the nursing home industry.
