Part 1 The first tweaks to HSWA 2015 are contained in the Regulatory Systems (Immigration and Workforce) Amendment Bill which is to be introduced tomorrow. This is concerning, as these appear to be buried within another regulation. There are several things that the bill aims to do First, we will have a look at the notifiable incident proposed changes. The bill proposes to change the current wording of “a notifiable incident means an unplanned or uncontrolled incident in relation to a workplace that exposes a worker or any other person to a serious risk to that person’s health or safety arising from an immediate or imminent exposure”. To “A notifiable incident is an unplanned or uncontrolled incident that exposes a worker or any other person to a serious risk to their health and safety. It must be notified to the regulator”. But what does this mean? The changes relate to: 1. Scope of Definition: • The first statement specifies that the incident must be "in relation to a workplace," adding a contextual boundary to where the incident occurs. • The second statement does not explicitly mention that the incident must be related to a workplace, but this is generally implied. 2. Details of Exposure: • The first statement emphasises that the risk arises "from an immediate or imminent exposure," indicating the urgency and timing of the risk. • The second statement does not specify the timing of the exposure, focusing instead on the serious risk itself. 3. Notification Requirement: • The second statement explicitly mentions that the incident "must be notified to the regulator," clearly stating the obligation to report the incident. • The first statement does not explicitly mention the requirement to notify the regulator, though it is generally understood in the context of health and safety regulations. Lets keep an eye on this!
