The mitigation hearings for 19 defendants among the 47 Hong Kong Democrats in a landmark national security case have been delayed by almost a month due to “unforeseen circumstances.” The court is set to hear mitigation pleas in groups in late August and early September. The defendants are among the 45 convicted of conspiring to commit subversion, which carries a maximum sentence of life imprisonment, for taking part in an unofficial primary election intended to help the pro-democracy camp secure a legislative majority. The Hong Kong 47, aka #HK47, are a group of pro-democracy politicians, lawyers, scholars, and journalists charged under the National Security Law for their involvement in the 2020 pro-democracy camp. Most of them have been detained since their 2021 arrest. HRF continues to condemn the arrest of pro-democracy activists and the suppression of opposition voices in Hong Kong.

Crimes that will incur up to a maximum penalty of life imprisonment include treason, insurrection, the incitement of a member of Chinese armed forces to mutiny, as well as colluding with external forces to damage or weaken public infrastructure to endanger national security. The draft Article 23 also proposed 20 years of prison sentence for espionage and 10 years for offences related to state secrets. Hong Kong’s Chief Executive John Lee on Thursday urged the need to pass the law “as soon as possible” amid an “increasingly complex” geopolitics backdrop. According to a government statement, 98.6% of views showed support for the bill during the public consultation. “The means taken to endanger national security can come in many different forms and the threat can emerge all of a sudden,” the statement read, adding that the sooner the legislative work is completed, the faster they can “guard against national security risks.” The proposal will need to be scrutinized by lawmakers through several rounds of debate before it becomes law. The draft legislation is necessary for Hong Kong to fulfil its constitutional duty to safeguard national security, China’s Ministry of National Security emphasized in its official WeChat account on Monday. Beijing imposed a controversial law four years ago, which stamped out dissent and led to the arrest of many Hong Kong pro-democracy activists. China’s 2020 national security law aimed at prohibiting secession, subversion of state power, terrorism activities and foreign interference. The U.S. State Department in late February expressed concerns about Hong Kong’s Article 23, and how it could be used to “eliminate dissent through the fear of arrest and detention.” Source link

In one of his first decisions as the new justice minister and prosecutor general, Adam Bodnar has launched the process for Poland to join the European Public Prosecutor’s Office (EPPO). He also reintroduced EU flags, which had disappeared under the previous eurosceptic administration, to the justice ministry office. Bodnar underlined that “The participation of Polish prosecutors in the work of the European Public Prosecutor's Office (EPPO) will allow for more effective prosecution of crimes against the financial interests of the EU and member states, including Poland. #FinCEN releases statement on the SBU v. Yellen case where an Alabama judge ruled the CTA is unconstitutional. 1. FinCEN will enforce the court order and not seek to penalize the litigants in that case for failure to comply with the #CTA. 2. This does not affect anyone else's CTA compliance obligations. 3. The ruling in Northern Alabama does not bind other courts and similar challenges in other jurisdictions may have different results. 4. When an Act of Congress is ruled as unconstitutional, it is more likely to be taken up by the US Supreme Court. A court of appeals may settle this matter without SCOTUS intervention. 5. The briefs and opinion for SBU v. Yellen did not explore all legal arguments. For instance, the CTA may be a valid use of congressional power to enforce various anti-terrorist financing, anti-bribery, and anti-tax evasion treaties. 6. Under U.S. law, a Senate ratified treaty is the "supreme law of the land", on par with the Constitution, and overrides state law. 7. An appeal would likely permit amicus briefs from third parties to inform the court of a wider field of legal arguments and perspectives. https://lnkd.in/ek9FMh_2

“No One Is Above the Law Amendment,” This is stupid and dangerous! I do NOT agree. This is about understanding the difference between good and bad people. Good people do NOT harm others, they have moral values and codes of conduct that prevents any ability to harm or abuse another person. These people have immunity like “peace initiators” because people commit crimes against them and they don’t retaliate.. like Christian’s they do NOT have an intention to harm others. Bad people harm others and they have an intention to harm others and they use corruption & deceptive tactics, strategies, and unethical practices to do so. People are NOT above the law, they spent a lifetime earning peoples trust of which the people promoted them to a position of immunity. To protect them from corrupt government, terrorists, enterprise crime organizations from committing crimes against our critical infrastructure harming our Defenses & National Security! Do NOT pass this!
