The Information Tribunal here dismisses an appeal of an ICO decision notice upholding the public authority’s entitlement not to respond, on sections 14(1) and 17(6) Freedom of Information Act grounds, to a request for information. Section 17(6) FOIA allows an authority to decline to provide a refusal notice where it receives a vexatious request and has previously notified the requester that future vexatious requests will not be responded to. There’s just one problem: I think there is a good argument that this new request was for environmental information. It was for information about refurbishment of a play park on a village green in Romney Marsh. Section s17(6) FOIA does not allow a public authority to refrain from responding to a future request which falls instead to be handled under the Environmental Information Regulations 2004. I have little doubt that the request could have been refused under regulation 12(4)(b) EIR (the equivalent of the s14 FOIA vexatious refusal) on the grounds it was manifestly unreasonable, so there’s an argument this doesn’t matter. But I find it surprising that neither the ICO nor the Tribunal recognised the point. https://lnkd.in/eGc8SqbB

PMO's quick comment This week's Supreme Court judgment in Abidha Nicholus largely stabilises the jurisprudence on the jurisdiction of the ELC and NET. It reflects the Supreme Court's judgment in Bia Tosha and deeply impacts the drafting of pleadings on environmental and land questions. The Supreme Court is saying that once you raise constitutional questions in your pleadings- only the High Court, ELC, or ELRC Court will have jurisdiction to determine the complaint (s) as the case may be. This thinking juridically impacts the doctrine of exhaustion of remedies ; it freezes the powers of tribunals and would ultimately impact access to justice. In constitutional law- the Supreme Court's attitude fortifies the theories of juristocracy and judicialisation of disputes. The apex Court appears to be saying that strictly the formal courts are the ultimate nirvana when it comes to the determination of constitutional violations. Tribunals can't touch, hear, or smell any dispute where a pleading mentions a constitutional text. But I have one pragmatic question; It is possible to frame environmental and land complaints without citing a constitutional violation ? Is there any labour matter where a parson can infringe the law without violating the Constitution ? What do you think ? Peter Wanyama [ PMO]

Happy to share that our co-authored paper with Raman Ojha, titled "The Road to Green Administrative Justice: EU’s Battle Towards Compliance with the Aarhus Convention," is now published in the second issue of the Maastricht Student Law Review (MSLR). 📚✨ Our paper delves into the challenge of access to justice in environmental matters, specifically addressing the research question: What are the key remaining non-compliance violations of the internal review procedure of Regulation 1367/2006 after the amendments introduced by Regulation 2021/1767, as per the Aarhus Convention? The paper addresses issues such as state aid, lack of impartiality, and external legal effect. Furthermore, it explores options for redress to tackle these non-compliance issues.
