Did you know? Under U.S. law, a person may apply for asylum at a port of entry or from within the United States. The law explicitly permits people who are in the United States to seek asylum, whether they entered with documentation or not. This isn't just numbers—it's a testament to the power of having someone in your corner. Over the past decade, Immigration Court records reveal that TWO-THIRDS of asylum applicants were deemed LEGALLY ENTITLED TO REMAIN in the United States (over 685,000 cases). This underscores the critical role of legal representation in securing asylum or relief from deportation. In FY 2024, 94% of successful asylum applicants had legal representation. Compared to those facing deportation orders – only 14% had an attorney by their side. Reducing the time asylum seekers have to present their case will lead to individuals with valid claims being deported back to danger, even though these numbers prove that most could have successfully made their case with an attorney. This highlights the stark contrast in outcomes between those with and without legal assistance, which is why we must move toward universal representation for ALL. Using the term "undocumented" instead of "illegal" is often preferred because it focuses on the lack of legal documentation rather than implying criminality or moral judgment. This choice of language humanizes individuals by emphasizing their status as lacking proper paperwork rather than labeling them as inherently criminal or unlawful. By avoiding the stigma associated with terms like "illegal," "undocumented" promotes more respectful discourse and acknowledges the diverse reasons why individuals may lack documentation, including seeking asylum or better economic opportunities. Additionally, "undocumented" reflects the legal reality that not all individuals without proper paperwork have committed a crime, as immigration violations can vary from civil infractions to criminal offenses. Overall, using "undocumented" demonstrates sensitivity to the complex circumstances of migrants and contributes to more accurate and respectful conversations about immigration. #UndocumentedNotIllegal #HumanizeMigration #RespectfulLanguage #LegalStatusAwareness #ImmigrationDiscourse #DignityForMigrants #SensitiveLanguage #DocumentedDignity #MigrationRealities #InclusiveLanguage

Today I was in court, and the judge was frustrated because she had an entire room of people without attorneys who didn’t know the complicated and nuanced procedures of immigration court. And this was just a basic scheduling hearing, let’s not even get to complicated final hearing where pro se respondents are expected to make complicated legal arguments they don’t know, utterly reliant on an (oftentimes unfriendly) judge and (oftentimes unqualified) interpreter. Universal representation doesn’t mean everyone will win their case. But it means people won’t lose their case because they lack the legal knowledge to represent themselves. I cannot reiterate how complicated immigration law, in particular asylum law, is. I’ve been practicing mostly asylum law for eight years and the law is constantly changing. It can be difficult for attorneys to keep up, much less persons who had to flee, lack resources, and do not speak English. Losing an immigration court case means deportation. That can be catastrophic and deadly. We should be creating a system of universal representation and due process. Additionally, this will help the inefficiencies that are rampant in immigration court. Judges who are frustrated at the pro se respondents who don’t properly file documents (a process not intuitive or easy, especially here in the NYC courts), who don’t understand the complicated legalese the judges speak in regardless of their audience will be able to move through hearings far quicker with attorneys.
