These are the sorts of employment agreement clauses you don't think about until you need them. Having the option to either put someone on garden leave, or pay them in lieu of notice, can be handy when the time comes. And it starts with getting your terms right at the outset.
Two options for employee notice periods that you’ll want in your next employment agreement: ▪ Garden leave - The right to send someone home for their period of notice. They remain your employee during that time. ▪ Payment in lieu of notice - The right to pay someone out their notice period. They stop being your employee but get paid what they would have earned had they been employed for the notice period. Both options assume you don’t need their full services anymore. The choice is whether you want to keep them employed for their notice period. Garden leave keeps them bound by their employment obligations for their period of notice. Paying in lieu allows them to move on immediately - no strings attached. Give yourself the flexibility to decide by including these in your standard employment agreement terms.
