The Political Guidelines for the next Commission (2024-2029) have been published, revealing key insights into the future of transport and digital under Ursula von der Leyen's leadership. The focus is on enhancing competitiveness and revitalizing the Single Market, with plans for expansion to the East and a new competition law approach to support companies in global markets. Energy cost reduction is also a priority. Specific proposals for the transport sector include a Single Digital Booking and Ticketing Regulation for rail services and a review of regulations for achieving the 2035 climate neutrality target for cars, emphasizing the role of e-fuels in addressing energy challenges. In the digital realm, the guidelines highlight the enforcement of digital packages, the introduction of a European Data Union Strategy for seamless data sharing, and an AI strategy. The overarching goal is to boost competitiveness through digital innovation and effective data utilization, ensuring the full benefits of new technologies are realized. The Florence Transport Week is coming to an end with our first Aviation Regulation Conference, co-organized with Steven Truxal International Institute of Air and Space Law (IIASL), Leiden University. And about the map... In Florence we host the historical archives of the European Union in an amazing historical building. They showed us the original document with the first map of the TEN-T Trans-European Network- Transport. The power of the map!

The last day of our Summer School in Florence is devoted to the definition of the agenda for the next Commission. Some keywords: Competitiveness, implementation (regulatory fatigue), strategic autonomy/security of supplies, energy as a bottleneck, security, accession... and always the construction of the Single European Transport Area as the ultimate goal! Keynote speech by Deputy Director General DG MOVE Herald Ruijters opens the second day of the Florence Summer School on Transport Regulation. Is Europe sufficiently resilient for geopolitics and climate? The recent crisis (COVID, Ukraine, climate events) have shown loopholes in EU transport regulation. What is the way forward? Fine tuning of regulation is necessary, new instruments might be explored (resiliency funds, PSO-type obligations, etc), but at the end of the day investment in infrastructure will be necessary (redundancies, adaptations)... Who should pay for a more resilient transport system? We opened the Florence Summer School on Transport Regulation! We started with an overview of the evolution of EU transport regulation from the 1980s to the challenges for the new Comission. The Single European Transport Area is always the objective, but it's built through different tools: introducing competition has been the main driver. However, as times has passed there are new challenges and opportunities. Sustainability is of course the main challenge and it has driven the work of the Commission over the last years with the Fit for 55 package, counting emissions, etc. Does it need to be refined? Smart transport is an opportunity in improve efficiency, but the right framework for data sharing needs to be defined. A challenge for the next Commission. Further challenges are resiliency and even military transport, but the word in town is COMPETITIVENESS. Europe is a leader in transport, and a reason of European competitiveness. But there is room to improve efficiency by using technology to improve coordination of complex ecosystems. Regulatory reform is necessary to keep the competitive edge. Our keynote speaker today is Dominik Piotrowski. The US Supreme Court has just published a landmark judgment on the powers of regulatory agencies. When statutes are silent or ambiguous with respect to a specific issue, who should be the ultimate interpreter of the statute? A new perspective on the ultimate challenge in regulatory activity: What are the limits of the discretionary powers exercised by regulatory agencies? The Chevron doctrine ruled since 1984 that it was the privilege of the regulatory agency to make the interpretation. Courts would have to defer to their interpretation. In LOPER BRIGHT ENTERPRISES ET AL. v. RAIMONDO, SECRETARY OF COMMERCE, ET AL. "Chevron is overruled. Courts must exercise their independent judgment in deciding whether an agency has acted within its statutory authority, as the APA requires. Careful attention to the judgment of the Executive Branch may help inform that inquiry. And when a particular statute delegates authority to an agency consistent with constitutional limits, courts must respect the delegation, while ensuringthat the agency acts within it. But courts need not and under the APA may not defer to an agency interpretation of the law simply because a statute is ambiguous". The dissenting opinion (signed by 3 justices) explains in simple terms the traditional arguments justifying the agencies' discretionary powers: "Some interpretive issues arising in the regulatory context involve scientific or technical subject matter. Agencies have expertise in those areas; courts do not. Some demand a detailed understanding of complex and interdependent regulatory programs. Agencies know those programs inside-out; again, courts do not. And some present policy choices, including trade-offs between competing goods. Agencies report to a President, who in turn answers to the public for his policy calls; courtshave no such accountability and no proper basis for making policy. And of course Congress has conferred on that expert, experienced, and politically accountable agency the authority to administer—to make rules about and otherwise implement—the statute giving rise to the ambiguity or gap. Put all that together and deference to the agency is the almost obvious choice". What do you think?
