Many ideas promise to be true game-changers in the minds of their inventors. Yet precious few inventions achieve the commercial success necessary to be credibly called a breakthrough innovation. It seems like a universal situation in which promising ideas rarely benefit from enough resources to 1. build the idea, 2. validate it in the market, and 3. plan strategically and invest in tools to win the market. The most commonly made mistake I see from inventors who do not value their own time is to build the solution, and only when the budget is nearly gone do they begin to address product market fit. Professional entrepreneurs understand how powerful it is to develop solutions for market-validated problems as opposed to finding problems for their invention. They also understand that in many instances, pairing voice of customer (VoC) with a digital twin for their idea in the form of a patent application plays a vital role in business development. Patent applications as an outreach tool are helpful with: 1. Avoid IP escape by focusing discussions on claimed aspects of the invention. 2. Delaying the need for an NDA. 3. Creating an asset that supports your counterparty in advocating for you with internal stakeholders. 4. Addressing the question: "Why should we work with you?" But how do capital-constrained companies approach patents and their costs when filing a patent makes sense? During last week's High-growth technology business community, the European Patent Office, and Licensing Executives Society International (LESI) invited the CEO of Rastal and Connect One Digital AG to discuss Digital Transformation in the restaurant/hospitality industry. During the discussion, fellow IP practitioner Wanxing Eugene Ho tackled the challenging question of how to approach patent filings for potentially valuable inventions. Given his expertise in Asia, he suggested the benefits of filing a PCT direct case. This got me thinking about the US approach. In the US, provisional utility applications are an option to secure a priority date ahead of market testing. For platform technologies with robust specifications, filing fees for a non-provisional application often exceed $4,000, whereas a small entity provisional fee is $120. A provisional filing opens a 12-month sprint to derisk the technical development and find product-market fit. During the sprint, inventions are sharpened by experimentation, refined during systems integration, and feature lists are perfected based on market feedback. Revenue streams should be a phase gate for converting provisional patent applications to non-provisionals at the end of the sprint. If the technology does not gain traction during the sprint, it often makes sense to pivot based on the gleaned market intelligence and VoC data. Innovation and patents are locked in a complex dance Innovation is the lifeblood of progress. It's the spark that ignites new ideas, propels technological advancements, and shapes a better future. But how do we incentivize this creativity? Patents act as a reward system. By granting inventors a temporary monopoly on their creations, patents provide them with the financial security to recoup investment costs and potentially generate profit. This financial incentive encourages inventors to pour time and resources into research and development (R&D), ultimately leading to a greater volume of innovations. While patents offer undeniable benefits, a well-functioning system is crucial to ensure they continue to fuel progress, not hinder it. By fostering collaboration, transparency, and competition, we can leverage the power of patents to create a brighter future for all. Globally innovation focus reaches new highs, as per Nasscom’s report Globally IP creation is gaining prominence with 3.46 million patents filed in 2022 compared to 3.4 million in 2021 The patent filing landscape in India is booming! Here's a breakdown of the positive outlook: Growth Trajectory: India has witnessed a remarkable surge in patent filings, with a record-breaking 24.6% increase in FY2023. India’s share increased to 2.2% from 1.8% during the same period. Computer technology continues to maintain its top position among all application areas, doubling its share over the last decade. Share of women patent filers globally grew from 16.5% in 2021 to 17.1% in 2022. India recorded an increase from 10.2% in 2021 to 11.6% in 2022. Domestic Drive: The trend of Indian residents filing more patents is encouraging. In FY2023, over 50% of applications originated from domestic entities, reflecting a growing awareness of intellectual property (IP) rights. Evolving Landscape: Other interesting trends include a rise in filings by women inventors (reaching 11.6% in FY2022) and a surge in applications from Tamil Nadu, currently the leading state in patent filing. While the outlook is bright, some challenges remain: Balancing Exclusivity and Competition: Ensuring patents incentivize innovation without hindering competition through excessive exclusivity is crucial. Streamlining Processes: Simplifying and expediting the patent application process can benefit smaller inventors. Overall, India's patent filing scene is experiencing a surge of activity, driven by domestic innovation and a focus on technology. Intellectual Property Boom in Tamil Nadu: Role of Tamil Nadu DeepTech Startups In a landmark achievement, Tamil Nadu has surged ahead of all other states to become a leader in Intellectual Property (IP) filings in India, as revealed by the latest NASSCOM report on Patenting Trends in India 2024. This remarkable accomplishment is a beacon of the state’s thriving innovation ecosystem, powered significantly by DeepTech startups. The Intellectual Property Surge Tamil Nadu's leadership in IP filings is not just a statistic but a compelling narrative of strategic vision. Tamil Nadu has recorded a 20% increase in IP filings year-on-year, contributing to 9.3% of the total IP filings during FY23. The state's diverse innovation landscape includes significant contributions from sectors such as Information Technology, Biotechnology, Manufacturing, Healthcare, and other emerging technology domains. Educational and scientific institutions have emerged as key drivers of innovation, with institutions like the IIT Madras, with more than 1300 IP’s registered. Government policies like National Intellectual Property Awareness Mission (NIPAM) and centers like the Tamil Nadu State Council for Science and Technology (TNSCST) along with Intellectual Property Facilitation Centres (IPFC) are creating awareness and specialized training programs on Intellectual Property Rights(IPR). The Path Forward: Collaboration and Innovation for Continued IP Growth Tamil Nadu’s impressive leadership in intellectual property filings is largely due to its robust educational ecosystem. The state ranks first in PhD enrollments and leads in Gross Enrollment Ratio (GER) in higher education at 47%, nearly twice the national average of 28.4%, according to the All India Survey on Higher Education by the Ministry of Education. To capitalize on leadership in IP filings, Tamil Nadu must translate groundbreaking ideas into tangible technologies, enhance technology transfer mechanisms, and improve collaboration with industries and government. Innovation hubs like the Tamil Nadu Technology (iTNT) Hub are enablers, facilitating enhanced industry-academia collaboration, improving research output, narrowing the industry-research gap, and safeguarding IP. DeepTech startups and strong government initiatives prioritizing IP-driven growth, incentivizing research, streamlining IP processes, and enhancing collaboration through hubs like iTNT, Tamil Nadu's DeepTech startups will attract increased investment and drive the state towards its vision of becoming a $1 trillion economy by 2030.
