What is the latest in the Weight Loss Mass Tort? Following the tragic death of Judge Pratter, Judge Marston held an in-person status conference and has entered 2 orders after being appointed head of the MDL which now has over 100 filed cases. The parties continue to work on the back office requirements of moving an MDL, but the most important upcoming event includes scheduling of a science day. Science day is the first real opportunity each side has to educate the court about the background, key issues, and injuries in the Mass Tort. These presentations take hours and involve in depth back and forth. Science day will be particularly interesting in the Weight Loss Mass Tort as there appears to be a split about the true scope of injuries. In addition to stomach paralysis and intestinal issues, some firms are now investigating potential cancers associated with use of these medications. Exciting News! The National Plan to End Parkinson’s Act is Now Law! On July 2nd, President Biden signed into law the National Plan to End Parkinson’s Act, marking a monumental step in our fight against Parkinson’s Disease! This groundbreaking law aims to accelerate a comprehensive solution to curing and preventing Parkinson’s Disease in all its forms. It brings together key federal agency stakeholders, nonfederal experts, patients, and caregivers to create a national plan for prevention, treatment, and a cure. Shaun Rothwell was riding his bike to work when he was side-swiped by a LA Metro City Bus, suffering soft tissue injuries to his low back. At trial, the defense admitted liability so the only issues were causation and damages. Like most soft tissue cases, the defense launched an aggressive attack on the credibility of plaintiff – no police report, no ambulance, attorney referred medical care, chiro liens, subjective and inconsistent complaints of symptoms/pain, and Facebook posts used to impeach Shaun during his testimony. The defense argued that there was no objective evidence of any injury; the only objective evidence showed that Shaun’s injuries and complaints were more likely the product of pre-existing degenerative disc disease as opposed to the crash. Finally, the defense undermined Shaun’s claim of ongoing pain by pointing to significant gaps in treatment, including the fact that Shaun had not received any medical treatment whatsoever for more than a year and a half leading up to trial. Despite these defense arguments, the jury awarded a total verdict of $352,824 broken down as follows: Past Meds $17,824… Past NonEconomics $85,000… and Future NonEcon $250,000.
