At Bird&Be, we've been closely following the recent Alabama Supreme Court ruling regarding frozen embryos designated as "extrauterine children" and its implications for IVF and fertility care. Already, several providers in Alabama have paused IVF treatments over concerns of legal risk. There are serious ramifications of political interference with healthcare decisions; it is necessary that stakeholders be involved in decision-making processes, and should include patients, clinicians and domain experts (embryologists, counselors, geneticists, ethicists, etc). Although every embryo may represent a potential future child, the fact is that the majority of embryos are non-viable. Not all embryos result in live births, and IVF patients can attest to how many fertilized eggs (early stage embryos) it may take to reach success (if they're fortunate). Treating embryos as unborn children will pile stress and unnecessary complexity onto patients going through an already tough journey, restricting clinicians from practicing best-in-class medicine, and raising many difficult questions: Would all embryos need to be transferred? Even PGT-A abnormal ones? What blame or even prosecution could practitioners face if an embryo doesn't survive thaw? Will clinicians be forced to limit the number of eggs fertilized at any given time to ensure no surplus embryos are generated? One egg at a time is a very inefficient (and very costly) approach to IVF. The ruling also poses challenges for patient access to care, both geographically and financially. As clinics navigate the legal complexities we're seeing now in Alabama, patients may face delays and uncertainty in their fertility treatment journeys. At Bird&Be, our mission is to educate early and advocate for expedited care, improve accessibility to preconception resources and fertility treatment. However, this ruling can have a ripple effect, further threatening access to equitable fertility care and reproductive rights in other jurisdictions. Alabama Supreme Court's recent ruling that frozen embryos are "children" is a continued assault on our freedoms and erosion of the doctor - patient relationship. #HelloAlpha #AlphaTelemedicine #ACOG #ASRM https://lnkd.in/gyJXA2vH The extension of personhood to include extrauterine frozen embryos represents a further threat to our reproductive rights. It’s not a big leap from frozen to fresh embryos and that life begins at conception. Why should the Court decide a societal issue? The Court is out of step with the majority of U.S. adults, including people living in states with the most restrictive abortion laws, who favor allowing abortion at least until six weeks into a pregnancy. How will this ruling impact the field of infertility and the ability of a couple with infertility to achieve a live birth? One result of the Dobbs decision was that medical trainees began incorporating state abortion access into their residency program choices. (Source) The Alabama Supreme Court ruling, if it stands and gains ground in other states, threatens to further reduce access to care and increase health care disparities between states. Where does that leave existing frozen embryos in the state of Alabama? Now that frozen embryos are no longer property, outcomes for failed embryo transfers and equipment malfunction in storage may become fodder for future litigation. Unpaid bills for storage of frozen embryos may become an element of child support law. Frozen embryos may become obsolete, i.e., no longer a choice potentially leading to multifetal pregnancies and increasing rates of neonatal morbidity and mortality. The physician-patient relationship is built on competent and compassionate care by a physician that meets the expectation and benefits a patient based on the 4 clinical ethical principles: Beneficence Maleficence Autonomy Justice Most of us became doctors to help people. Criminalization of positive intention pits infertility teams against patients and will have devastating effects. What’s next - the criminalization of miscarriage; the criminalization after a missed menstrual period?

First reported on CNN — Democratic lawmakers have introduced legislation aimed at making access to infertility treatments, such as in vitro fertilization, a statutory right. This comes amid growing concern that anti-abortion bills may threaten access in some states. On Thursday, Illinois Sen. Tammy Duckworth and Pennsylvania Rep. Susan Wild introduced the Access to Family Building Act, which would make it a statutory right for patients to access assisted reproductive technology, such as in vitro fertilization or IVF, continue treatments and retain authority over how sperm or egg cells are used during such treatments. The new bill could supersede states’ strict abortion laws when it comes to discarding a patient’s embryos during the IVF process or even terminating a pregnancy when a patient is implanted with multiple embryos while using assisted reproductive technology.
