#EJAFellowUpdate The past few weeks at Community Legal Aid of Worcester have really opened my eyes to the struggles people face due to the housing crisis. According to an article by Forbes published in April of this year, Worcester has the 3rd worst rental market in the country. There are simply not enough vacancies to meet demand which is causing rent to exponentially increase. Landlords are pushing long term tenants out because they know they can rent those units out to someone else for hundreds of dollars more per month. Those desperate to find affordable housing are often forced into substandard units. I sat in on a meeting with a client who reported dealing with a bedbug infestation for months. They mentioned they go to bed wearing hoodies drawn tightly closed and long gloves in an attempt to prevent bites. Another case involves a mouse infestation that has been going on for years and is causing major health issues, including their young child being taken to the doctor for multiple bites on their body. Mold, broken windows, water damage, and inadequate/no heat are also reported. Changing housing is not a realistic option when dealing with such a difficult market. Part of the work CLA does when representing clients during eviction proceedings is to let the clients know their landlords are legally required to maintain a safe and habitable environment. In addition to using these conditions as a defense against eviction, CLA attorneys also advocate to get these issues resolved as quickly as possible. It’s disheartening to hear and see these horrible conditions, but it makes the positive impact of CLA’s work all the more rewarding. My colleagues at Moore Barlow, my fellow committee members of the Surrey Junior Lawyers Division and I, are taking on a sponsored 10km walk on Monday 8th July to raise funds for legal advice agencies in Surrey. Legal advice agencies make access to justice available to more people in need. This need became more obvious with the recent cost of living crisis. Access to justice is imperative in our community, as it helps individuals understand and enforce their legal rights and helps to maintain trust in the legal system. Faced with finding a new home after a fire at her rented flat, Hamsa was also worried about her tenancy rights and potential claims arising out of the fire. She approached Equal Justice 平義社 who, in cooperation with The Free Legal Advice Scheme, empowered her to pursue her case. Hamsa was horrified when she came home to find the sub-divided flat she rented for her and her two children had been badly damaged in a fire. Worried about her legal position, Hamsa came to Equal Justice 平義社. Our case workers explained how rights in contract law, and in particular under a tenancy agreement, are governed and potential remedies. Additionally, as one of the official referral organisations, Equal Justice was able to refer Hamsa to the Duty Lawyer Free Legal Advice Scheme. She was assigned a lawyer who gave her vital information on her rights as a tenant and how she could resolve her case. As a result, Hamsa was able to obtain the official report from the Fire Department which identified the cause of the fire as a faulty electrical fan. With the information and knowledge that she had gained, Hamsa was empowered to approached the manufacturer of the fan to discuss the incident and the impact it had had on her life. As the year ends, many of us plan to spend time with loved ones in the warmth and comfort of our homes. Unfortunately, not everyone is confident they’ll have stable housing for the holidays. The threat of eviction will loom ominously over far too many Hudson Valley households this season. In some cities in our region, landlords file an average of one eviction petition for every six tenant households each year! 40% of residents facing eviction are children. 12% are under five years old. Some of those tenants lose their homes, despite legal defenses, simply because they can’t afford an attorney. And eviction is only one of the many legal challenges facing low-income individuals and their families HVJC’s attorneys provide free high quality legal counsel and representation in a variety of legal matters, without regard to immigration status. So far this year, HVJC represented 1,055 clients benefitting 2,859 Hudson Valley residents. Next year, the office will help even more. But HVJC can’t continue this urgent work without your help.
