Because surely it will arise during the cause of the performance of the contract. In what ever form. Of course that is when you look for a lawyer.. Your legal mechanic. Stop it!. I am usually stressed out when it happens, and I have to be doing more than I should ... It's always better to have a working contract document. To serve as a reference point always..you don't deserve the headache, neither does your resources. But you won't listen,so it's fine. Thursday Thoughts: In-House Counsel I’ve had several conversations recently about the role of in-house counsel. The way I see my role is to be an enabler for the business. I don’t just wear a legal hat, I also wear a business hat. My job is not only to provide legal advice to the business but to also provide advice to the business that allows them to achieve their goals. This level of creativity and involvement requires two things: time to actually dig in and involvement from the beginning. I see my role in-house as essentially being a solution-provider. If I have to say no based on legal requirements, I will, but otherwise I see my role as providing creative solutions to allow my clients to achieve their business goals. What are some of your favorite things about being in-house? My favorite is helping my clients achieve their goals through creative legal solutions.

Here's an important piece of relationship-building advice (outside the realm of client relationships) to act on: When someone impresses you, let them know. Here are three examples of what I mean: 1. When editing a junior lawyer's work, make sure to note what they did right, not just wrong, in the margin. 2. When opposing counsel extends courtesy and exhibits professionalism, compliment their approach. 3. When a member of your firm's support team shows initiative and ingenuity, let them know you noticed. In high pressure situations and professions, it's easy to dwell on the negative and overlook the positive, as if excellence is a baseline expectation not worthy of note. But it's a mistake to be stingy with praise. Not only do we tend to get more of what we praise (and make someone feel good in the process), we make a positive impression ourselves. This engenders trust, loyalty, and likability—the bedrock elements of strong relationships—up and down the chain of command, with clients and colleagues, and, yes, even with adversaries. And as we all know, in the small world that is the legal profession, relationships are everything.
