This week in UPC Weekly from Mewburn Ellis we take another look at how the UPC is developing its case law on public access to the court file. We report on an order from the UPC Local Division Vienna which seems to us to have taken something of a backwards step by blocking access to the UPC court file for ongoing proceedings for a party claiming a legitimate interest in the case. It is possible that this order would be overturned on appeal, because the facts of the case seem to align with what the UPC Court of Appeal said would be suitable reasons for accessing ongoing proceedings. For any party seeking access to the UPC court file for ongoing proceedings, it seems clear that you really have to make your case in detail to show why you have a direct legitimate interest in seeing the written pleadings and evidence. Emphasise the similarity of your situation with that of one of the parties in the UPC proceedings, such as: 📣 similarity of alleged infringing product, 📣 needing to see how the patentee construes materially unclear claims, 📣 similar reasons for wanting revocation of the patent.
