Recent advances in labor law/regulation in the US, including especially new rules re overtime and who can and cannot be an "exempt" employee, are making a profound difference for the people who keep the country moving. And lest you ask, "What's this have to do with my usual beat?" 1) My core beat is behavioral health and the #1 behavioral health issue in this country is that we live in a racist oligarchy. No amount of mindfulness and cute coaching tips is going to relieve the anxiety and despair of the 55% of households who couldn't cover a $1,000 emergency. 2) I co-own just the kind of small business (restaurant/bar) in which many of these violations occur ... but I can sure has hell tell you they don't occur at ours. Hey everyone! I wrote in Slate Magazine about a case I handled when I was a baby lawyer: it involved a Burrito chain that had like five "managers" in each location to manage like three workers. It was an attempt to avoid paying overtime by giving people fancy titles. A new rule from the Biden U.S. Department of Labor will stop this kind of shenanigan, and make sure that ordinary workers get paid extra when they have excessively long work hours.
