RONASCOSMETIC later proved legitimate ownership by showing prior use and registration of the trademark globally. Finally, the DIP granted RONASCOSMETIC the trademark. This case highlighted Cambodia's nuanced approach in case there are two or more applications relating to identical/similar marks for identical/similar goods or services filed on different dates. Specifically, the Cambodia Trademark law provided that the registration would be granted to those who can determine their rights upon application in the prescribed manner (created and used in production/business activities). This is to ensure fairness to the legitimate ownership of the trademark, and also help to avoid bad-faith registration in the country. Our Partner, Reagan Roy Teguh, has authored an article titled, “Is Your Brand Well-Known In Another Country?” in Mondaq, providing advice from his perspective on protecting trademarks in foreign markets. Growing a brand or trademark internationally requires a substantial effort and investment. While one brand may be well-known in its home country, its recognition abroad can be different. Indonesian law offers protection for well-known trademarks even if they are not registered locally but certain determination factors need to be observed. Applications for the protection of trademarks similar to well-known ones can be rejected, and legal action can be taken to protect the mark. On January 27, 2025, I had the opportunity to attend The Consultation Meeting on the Protection and Enforcement of Intellectual Property Rights (IPR) in Thailand 2025, hosted by the Department of Intellectual Property (DIP) in Thailand. I was honored to join my fellow AmCham Thailand Legal Committee leader Christopher Knight, Board Liaison Wiyada Srinaganand, Committee Coordinator Jen Meckhayai, and Emi Rowse Igusa in representing The American Chamber of Commerce in Thailand (AMCHAM Thailand) at this important discussion. During the meeting, I raised a crucial concern on behalf of Pisut & Partners regarding the increasing number of bad-faith trademark applications filed in Thailand—particularly by foreign applicants selecting well-known marks from global brands, including those from the U.S., and registering them locally. Many of these applications are made with the intent to later sell the marks back to the rightful owners, creating unnecessary obstacles for genuine businesses entering the Thai market. This issue was acknowledged by both attendees and DIP executives, who recognized the impact on foreign investment and brand protection. We at Hafiz Zubir & Co. (HZAC) have successfully registered the trademark for Siti Khadijah Group in the Philippines, just one month after achieving the same in Brunei!
