🔏 On July 24, the Antimonopoly Committee of Ukraine announced the start of the second stage of competition law reform. This stage is a crucial step towards harmonizing competition protection legislation with European Union norms, particularly Articles 101 and 102 of the Treaty on the Functioning of the EU and Directive 1/2019. The main goal of these changes is to strengthen the institutional #capacity of the AMCU to ensure fair competition and equal conditions for all market participants. The IBR Team is actively engaged in the workstream dedicated to the implementation of the abuse of the superior bargaining position. In particular, the IBR Team, in collaboration with KPMG Ukraine, has developed a comprehensive #study on late payments issues in the Ukrainian #retail sector as part of the superior bargaining position abuse practices. The study has been successfully presented to the public recently. We also assisted the #AMCU in drafting relevant sections of the Draft Law and providing #expert feedback to the AMCU on various issues and EU practice related to the abuse of the superior bargaining position. Anastasiya Voronova, Legal Team Lead of the USAID Project "Investment for Business Resilience," spoke at the presentation, where she: 📌 Outlined the economic impact of late payments and other unfair practices on small and medium-sized businesses. 📌 Explained that the recommendations for preparing the relevant sections of the Draft Law regulating abuse of superior bargaining position were based on Directive 2011/7/EU of February 16, 2011, on combating late payment in commercial transactions and Directive 2019/633/EU of April 17, 2019, on unfair trading practices in business-to-business relationships in the agricultural and food supply chain. 📌 Encouraged market participants to provide feedback on the Draft Law.
