HC: Allows taxpayer to file appeal against adjudication order, after Safari Retreats verdict : MP Chirantan Enterprises LLP Ruling : Madhya Pradesh HC pursuant to Supreme Court decision in Safari Retreats in a matter pertaining to leasing of an immovable property, rules on Input Tax Credit (ITC) entitlement; Contemplating if ‘building’ qualifies as ‘plant’ HC paraphrases paras 54,55,56 from SC judgment; Thus, with the liberty to “file all the necessary documents and rely on the law laid down by the Apex Court in the case of M/s Safari Retreats Private Ltd” HC relegates assessee to appeal remedy before the Appellate Authority; Assessee constructed a building on own land and leased the same to a school; The Adjudicating Authority passed a final order denying ITC worth 6.7 crores (approximately); Present writ petition has been filed challenging notice requiring assessee to show cause as to whether the building in question qualifies for the definition of plant for availment of ITC; Assessee citing Safari Retreats submits that it is entitled to ITC under Section 17 (5), clauses (c) & (d). #GST #GSTLitigation #GSTUpdates #GSTCompliances #GSTNews

RTO 9 Board of Directors – South Eastern Ontario Call for applications- 📅 open until May 16, 2024 RTO 9’s Board of Directors has undergone an evolution from being primarily structured to represent select municipalities across the region among key tourism sectors to being balanced by the experience and skills that Board members bring to the table. The four (4) individual Director positions filled at the 2024 AGM will fulfill a three-year term ending at the 2027 AGM. Applicants will represent the following regions in South Eastern Ontario: One (1) position from the West region, two (2) positions from the East region, and one (1) position from the Central region.
