#ThrowbackThursday to another landmark legal decision ... this one that is important for every insured driver in Nevada! Following an accident, State Farm agreed to defend its at-fault insured, but did so under a reservation of rights. The insured then settled with Hansen (the injured driver of the other vehicle). He then assigned his rights to sue State Farm to Hansen. Hansen proceeded to sue State Farm for bad faith, because the insurer refused to provide its insured with independent legal counsel. Eventually, the case escalated to the Nevada Supreme Court, which clarified crucial aspects of Nevada’s conflict-of-interest rules in insurance litigation: (1) Nevada law mandates that insurers must provide independent counsel to their insured when a conflict of interest arises; and (2) An insurer is compelled to provide this independent counsel when there is an actual conflict of interest, not just a potential one. Based on this ruling, insured individuals have the right to receive fair and independent legal representation -- paid for by their insurance company -- when the insurer's interests diverge from its insured's interests. Business Groups Urge Louisiana State Senate leaders to Jumpstart Stalled Tort-Reform Bills "A coalition of Louisiana business groups is urging state Senate leaders to break a legislative logjam that has kept a pair of tort-reform bills stalled in the Senate Judiciary A committee." "The coalition, which includes the Louisiana Association of Business and Industry, Louisiana Motor Transport Association, Louisiana Legal Reform Coalition and Louisiana Lawsuit Abuse Watch, also expressed hope that Gov. Jeff Landry would sign another pair of tort-reform bills as they reach the end of the legislative-approval process." These bills include: HB 24 - Requires plaintiffs to prove pain and suffering was caused by an accident HB 336 - Provides for disclosure of litigation financing agreements HB 337 - Provides qualifications on direct action against insurers in wrongful death/survival cases HB 423 - Clarifies calculation of medical expenses in litigation to be closer to the amount actually paid by the medical provider All four of these bills are part of Tim Temple’s legislative package designed to ease the state’s current insurance crisis and put downward pressure on rates paid by Louisiana families. “I urge Gov. Landry to support the entire package of auto insurance reform bills …” he (Temple) said. The pressure is building to get much-needed legal reform done. It is time to stop feeding the attorneys, who are the primary beneficiaries of high insurance rates. Legislators, the issue isn't going away just because the session ends on June 3, 2024. The people of Louisiana need rate relief now. Look at Florida if you need an example of what to do. But in the meantime, please take action on what is on the table.

Garcia & Artigliere lawyers Stephen M. Garcia and Rosalie Baladejo proudly acquired a $900,000.00 settlement on behalf of Southern California resident of a residential care facility for the elderly. Garcia & Artigliere's client suffered the development of stage 4 pressure injury on her coccyx in the defendant facility. The action vibrantly illustrated the difficulties in litigation against residential care facilities for the elderly who are generally small corporations carrying minimal, or often nonexistent, insurance. Oftentimes, through typical litigation processes the costs of litigation are such that given the minimal insurance policies there is just not sufficient benefit to the aggrieved plaintiff. As Stephen M. Garcia stated, "these facilities carry minimal insurance, force litigation to the hilt, and then try to run up costs so that the recovery to a plaintiff is not commensurate to their injuries. We are proud because of our long litigation and trial success history the insurance companies understand these tactics will not work with our firm and we will fully litigate matters to acquire justice, insurance or not. Here, because of that history we were able to settle our client's case quickly incurring minimal costs which maximizes the net recovery of our clients so as to in some small sense, provide a sense of justice for their suffering. It is a small token for the pain suffered by the family but it is an advantage that Garcia & Artigliere has over most law firms in this litigation area and we are glad to use it to benefit our clients."
