E-2 Visa Success Story: Supporting Business Expansion from Canada to the U.S. I recently helped a long-standing client navigate the complexities of the U.S. immigration process to transfer key personnel from their Canadian office to their U.S. subsidiary. The client’s company had been successfully operating in both Canada and the U.S. for over 20 years, but their goal was to expand even further by bringing vital employees into the U.S. office. During our consultation, we recognized an excellent opportunity: over the years, the parent company had made substantial investments in the U.S. subsidiary, making it eligible for the E-2 Treaty Investor Visa. The company was majority owned and controlled by Canadian citizens, and its investment in the U.S. business was more than sufficient to qualify under the E-2 visa category. Seeing the potential for the E-2 visa to support the company’s continued business growth, we prepared and submitted a detailed E-2 visa application to the U.S. consulate in Toronto. Our submission highlighted: The non-marginal business operations of the U.S. subsidiary, The qualifying investment made by the parent company, The positive economic impact of the business within the U.S. Our client attended an in-person visa interview and was issued a five-year E-2 visa. Even better, their U.S. company is now registered as an E visa business in Canada’s E visa program, allowing the business to sponsor additional Canadian citizens for E-2 visas and transfer key personnel to the U.S. subsidiary.
