On 11 June 2024, the Environmental Protection (Powers and Penalties) and Other Legislation Amendment Bill 2024 was passed. This significant piece of legislation, now officially the Environmental Protection (Powers and Penalties) and Other Legislation Amendment Act 2024, came into effect on 18 June 2024. The amending Act makes a number of amendments to the Environmental Protection Act 1994 (EP Act), with some of the key amendments being: • new principles being added to section 6A of the EP Act; • an amendment to the definition of ‘environmental harm’; • the introduction of a new offence for breaches of the general environmental duty; • the introduction of a new duty to restore; • changes to the duty to notify; • the replacement / consolidation of Environmental Protection Orders, Directions Notices and Clean-up Notices with the new compliance tool of Environmental Enforcement Orders; • the commencement of a new process for amending transitional environmental programs; and • changes to evidentiary provisions.
