In our collaboration with Justice Professor Joel Ngugi of the Kenya Court of Appeal, we're learning that dispute resolution, despite varied global practices, fundamentally shares core principles universally. From New York to Nairobi, the goal remains to reach mutual agreements, often through mediation or arbitration, guided by legal frameworks tailored to each culture's nuances. For example, Asian cultures might emphasize harmony and face-saving, while Western approaches may focus more on direct negotiations. The rise of Online Dispute Resolution, about which we are learning more, transcends borders, offering a digital platform for efficient conflict resolution. This evolution reflects a universal push for inclusivity and accessibility in justice. Whether it's adapting to societal changes like digital rights or training programs for effective dispute resolution, the essence remains consistent globally. Organizations like the International Court of Justice exemplify this on a macro scale. At the heart, whether in Kenya or elsewhere, effective communication and understanding each party's perspective are key, underscoring a universal human desire for fairness and harmony.
