Alliance for Housing Justice commends the White House's historic pledge to act on tenants' nationwide calls and curb skyrocketing rents. President Biden’s call for a cap on corporate rent increases is a testament to the power of organized tenants and advocates telling our stories, demanding more for our communities and not taking no for an answer. A call to Congress is just a first step – there is a lot more that the President can and must do to make affordable rents a reality for tenants in the United States. We will continue to insist that every one of us  — no exceptions —  deserves safe and stable housing, and that the best way to get there is for tenants and communities to keep organizing and building power to transform our broken housing system together.

Collaborative solutions are possible.

"It is the political equivalent of cats and dogs playing nice together. And something rarely seen in California. Two groups often at odds — YIMBYs and historic preservationists — are uniting behind a measure by San Francisco Assembly Member Matt Haney that is designed to make it easier to convert office buildings to residential housing, something that could help to revive San Francisco’s fading downtown and others around California. Seeking a way to simplify and accelerate the transition, Haney introduced office-to-housing legislation that would relax environmental review, authorize municipalities to move these projects more quickly through the approval process and offer tax incentives to developers. The YIMBYs wanted more residential housing. The preservationists did, too, and saw that adaptive reuse might be a way to maintain buildings that might be lost in California’s — at least stated — urgency to build more housing. So... Last week the Austin City Council Members voted 9-2 in favor of the changes to the land use rules. This is an attempt to encourage the construction of middle-class housing and affordable housing. The amendment would let property owners build more homes in neighborhoods restricted to one family living in one house on one plot of land. The changes coined HOME, or Home Options for Middle-Income Empowerment. “I think we can celebrate this moment and the achievement tonight as we create more housing opportunities across the city," said Council Member Leslie Pool, who represents parts of North Austin and whose office brought the measure forward. The idea is by loosening zoning restrictions, supporters reason, builders are able to build more homes, thereby increasing the supply and lowering the price of housing. The changes Austin council members passed go into effect in 10 days, but won't be able to be used by builders until February. Next year, elected officials will consider reducing the amount of land required to build a home. If this helps our city actually have some affordable housing, I am 100% behind it. Yesterday, planners in Minnesota got a huge WIN when the state legislature voted to protect comp plans advancing local housing reform from out-of-context environmental lawsuits. Passage of the Comp Plan Clarity bill also means that the City of Minneapolis can resume implementation of its 2040 Plan—a plan that has helped the city grow housing supply by 12% while rents grew by just 1%, according to @Pew. I’ve said it once—and I’ll say it again. Planning is THE best way to produce more diverse, attainable, and equitable housing options. A bill introduced in the U.S. House of Representatives seeks to repurpose underutilized government facilities for residential projects. The Government Facilities to Affordable Housing Conversion Act, which Reps. Adam Schiff and Jimmy Gomez, D-Calif., introduced April 2, would mandate an annual assessment of federal real estate holdings to determine their suitability for residential conversion.  Within a year of enactment, the secretary of the U.S. Department of Housing and Urban Development, the administrator of the U.S. General Services Administration Office of Inspector General Administration and the director of the Office of Management and Budget, would be required to submit an annual housing conversion report to Congress. The report would examine whether federal real estate is being optimized, if it should be reduced and if it could be converted to affordable housing units, the bill says. 

While the number of manufactured housing communities (f/k/a mobile home parks) in Massachusetts has gone down over the years (I remember the aptly named Walden Breezes located across the street from the public entrance to Walden Pond - a manufactured housing community that is long gone), those that remain are constrained by the provisions of G. L. c. 140, §§ 32A-32S (the Manufactured Housing Act) which establishes procedures that must be followed before such a community may be discontinued (advance notice requirements and a right of first refusal to owners). The Appeals Court's recent decision in Blackman's Point Homeowner's Association v. Call touches on the requirements of the Manufactured Housing Act, but really turns on the limitations a prior settlement agreement with the Homeowner's Association imposed on the property owner. That said, it is a good reminder that the nature of a property's use can carry with it specific statutory requirements before a sale or change in use (MGL 61, 61A and 61B for example) and that it pays to make sure you are teed up to comply before you put land on the market.

There are many reasons it is so difficult to build new housing in New York City — including zoning, the under-taxation of vacant and underutilized land, the continuing rise of construction costs, the elimination of important tax incentives, and intense and often misguided anti-development sentiments. In New York City most residential land is reserved exclusively for single-family homes.
