In California, drafting a last will and testament requires adhering to specific legal criteria, including written documentation, mental competence, and the signing and witnessing of the document. While the state doesn't recognize oral wills, it does permit deathbed wills, despite their potential to be contested in probate court. As sub-optimal as they might be, deathbed wills provide a better outcome than leaving asset distribution to the state's intestacy laws, which automatically kick in when a person dies without a will. The safest way to ensure your last will and testament achieve your goals is to follow the written/witnessed format before your deathbed. In the Estate of Jennings (Dec'd) [2024] WASC 31 - on 8 February 2024 the Supreme Court delivered a decision about the "chain of representation" in deceased estate matters. The chain of representation refers to the automatic transmission of executorship from one executor to the executor of their estate when they die: Jennings, [1]. The principle of "chain of representation" dates back to 1951 in England first set out in 25 Edward III St 5, chap 5 (1351). The common law position is set out in Drummond v Registrar of Probate (1918) 25 CLR 318, 321 - which states that: "an executor having taken probate of his own testator's will become executor, ipso facto, not only of that will but also the will of any testator of whom the other was the sole or surviving executor." That common law position applies in Western Australia: Jennings, [38]. The Court confirmed that the "chain of representation" operates automatically and "a separate application for a grant of probate over the original testator's will by the executor of the executor is not required - that is the very purpose of the chain of representation": Jennings, [40]. #estateplanning #probate
