For legal studies teachers: Compass - ABC IVIEW (26 May) - Restorative justice: criminal law is about delivering fair and appropriate consequences for convicted offenders having regard to the key purposes of punishment. The law is about people: victims, offenders and the community. Supporting the parties to actively and courageously participate in the justice process, to heal and to move on, are challenges with enormous potential benefits. This episode of Compass is an insightful springboard to discuss the complexities of restorative justice with students.

How Cuyahoga County picks attorneys to represent children Ohio sets rules for fairly appointing attorneys and the qualifications they must meet to be paid. Children accused of crimes have a constitutional right to an attorney, just like adults. Each of Ohio’s 88 counties gets to choose whether to provide public defenders, use nonprofit lawyers or appoint private attorneys for individuals unable to afford an attorney. The courts can also provide attorneys in child abuse and neglect cases. State and local governments share the costs, with the state reimbursing counties for most of what’s spent. Ohio also sets rules on how courts are supposed to fairly pick private attorneys to handle cases and make sure they are qualified. The state’s most recent budget includes $366 million to pay for public defenders, private attorneys and their costs for representing both children and adults for a two-year period. This article out of Australia raises interesting questions. I have always thought that we ought to have a system whereby domestic violence victims had a right to counsel, and if they qualified financially it should be provided by the public defender or private institutions funded by grant programs. This could easily be accomplished by increasing the surcharge on offenders and putting that into a legal services pool We charge $50-100. But if someone drives drunk we charge over $1000. This is a fix we could achieve. #domesticviolence

Check out PublicSource’s thoughtful article on the need for independence in public defender offices. Independence is one of 10 reforms we advocate in our just-released report titled, “Transforming Public Defense in Allegheny County: The Path Forward.” As PublicSource explains, our local Public Defender “has a history of being hamstrung and muzzled” by the County Executive’s office. If we want a fair and balanced criminal legal system, the Public Defender must be empowered to speak up when it sees injustice without fear of reprisal. We are a collective of crime victims, faith leaders, businesspeople, community group leaders, law enforcement, local government, medical and legal professionals, and private citizens who refuse to accept the state of public safety in our community as normal. The CSC focuses on ONE solution: legislative improvements to keep communities safe. Active members understand that while we may all bring divergent points of view to the table, our goal is consensus on paths forward. We have grown from our first meeting in Rochester, NY for the #FingerLakes and Greater #Rochester region in October 2022 to chapters in Erie, Niagara, and Onondaga Counties, the Mohawk Valley, and the Albany-Capital Region. We continue to gain support along the Interstate 90 corridor and throughout #NewYorkState. Our current initiative is directed at both chambers of the New York State Legislature. Our goal is to convince our lawmakers to fine-tune the criminal justice reforms of the past several years, which, while well-intentioned, had detrimental impacts on our communities—particularly our underserved and poor populations. The specifics of our initiative: 1) Establish a Risk of Public Safety Standard. Empower judges to detain those accused of crimes based on the danger they present to the community. New York judges are the only ones in the country who lack this ability. 2) Establish a Repeat Offender Standard. Immediately detain individuals rearrested with other charges already pending. Don't differentiate between "qualifying" and "non-qualifying" offenses. 3) Write Clean Law. Uphold the tenets of criminal justice reform by writing law easily understood by everyone - victims, judges, law enforcement, prosecutors, defense attorneys, and defendants. 4) Oppose Elder Parole Legislation. Not signed into law, this bill has been proposed repeatedly. It would mandate convicted criminals be considered for parole based upon age, regardless of sentence or crime - even murder.
