Bar tenders all over the globe have been told 'this is how you serve a Corana'. It's a one of a kind DBA. But there's more to this branding success story. Stores in New York are moving away or keeping their merchandise locked because of #RetailTheft. Norwegian Competition Authority announces NOK 16.1 billion reduction in fines in the “price hunter case” Today, The Norwegian Competition Authority (“NCA”) has announced that the fines it intends to issue to the three retail chains Rema 1000, Coop and Norgesgruppen in the “Price Hunter Case” will be reduced from NOK 21 billion to NOK 4.9 billion. In 2018, the NCA had notified the three parties in a statement of objections that it intended to issue fines totaling NOK 21 billion (approximately EUR 2 billion) for anti-competitive information exchange. Since 2011, the retailers had reportedly agreed to give each other access to each other’s stores, to obtain real-time information on shelf prices. In practice, employees (“price hunters”) were used to collect price information from competitors’ stores by physically entering the stores and scanning shelf prices. The NCA has announced that it is no longer considering the information exchange as a “by object” restriction, and the NCA has therefore turned its attention to the potential anticompetitive effects of the information exchange. From the start, this case has been interesting to follow, as the NCA is treating what appears to be collection of publicly available information as a hardcore competition law violation. The significant reduction in intended fines may indicate that the NCA is starting to realize that this case is not as juice as it initially appeared. It, however, noteworthy that the NCA is still intending to hit the retail grocery chains with quite substantial fines – especially given that fact that “by effect” cases are extremely rare, and fines in such cases even more so.
