U.S. Vice President Kamala Harris has announced Minnesota Governor Tim Walz as her running mate for the upcoming U.S. presidential election. Since Walz is an “official” for purposes of the SEC’s pay-to-play rule under the Advisers Act, political contributions to, and fundraising for, the Harris campaign may raise issues for investment advisers that manage or are seeking to manage the assets of Minnesota state public pension plans. This also impacts broker-dealers, swap dealers, municipal securities dealers and municipal advisors, which are subject to similar pay-to-play rules. In this OnPoint, Dechert's Brenden Carroll, Sonia Gioseffi, Derek Manners and Michael Murphy discuss the pay-to-play rule, compliance considerations and more. IRI testified today at the second congressional hearing this year to examine DOL’s flawed proposed investment advice rule. In this testimony, Jason Berkowitz, Chief Legal and Regulatory Affairs Officer at IRI, noted the alarming similarity to the now-vacated 2016 DOL fiduciary rule. Like that rule, this proposal will foster widespread retirement insecurity. Millions of low- and middle-income workers – especially those most impacted by the wealth gap – will find it nearly impossible to access the products and services they need to achieve a secure and dignified retirement.
