The FCC recently issued a Notice of Proposed Rulemaking requiring broadcast stations to disclose the use of Artificial Intelligence in political ads. Under the proposed rule, stations must inquire about AI-generated content, make on-air announcements, and include disclosures in online political files. While broadcasters support transparency, the question arises: should the responsibility of disclosure lie with campaigns rather than broadcasters? Both. We live in an era of misinformation and therefore mistrust. Artificial Intelligence can create artificial realty. With the programming that can make anyone appear to say anything, and make it nearly seamless. To assume a political campaign will actually take responsibility for lies would be the opposite of what has become standard operating procedure. Stations, and social media outlets, have to flag them, and be informed before airing. Should there be penalties for non disclosure? Perhaps the proposed rule should apply that to the advertiser, PAC, or whatever. The burden of the cost of fact-checking should perhaps fall on those who violate the policy.
