𝗕𝗮𝗰𝗸𝗴𝗿𝗼𝘂𝗻𝗱: The Supreme Court’s June decision in Loper Bright Enterprises v. Raimondo and Relentless, Inc. v. Department of Commerce overruled the 1984 Chevron doctrine, which previously allowed courts to defer to federal agencies' interpretations of ambiguous statutes. The ruling limits agency power and may lead to increased legal challenges to federal regulations. Chevron precedent influenced around 70 Supreme Court and 17,000 lower court decisions. 𝗦𝘁𝗮𝘁𝘂𝘁𝗼𝗿𝘆 𝗔𝘂𝘁𝗵𝗼𝗿𝗶𝘁𝘆: • Statutory authority gives agencies power to create and enforce regulations within legislative limits. • The recent ruling restricts agencies' ability to interpret laws broadly, necessitating more precise legislation from Congress. 𝗜𝗺𝗽𝗹𝗶𝗰𝗮𝘁𝗶𝗼𝗻𝘀 𝗳𝗼𝗿 𝗨𝗦𝗗𝗔 𝗢𝗿𝗴𝗮𝗻𝗶𝗰 𝗣𝗿𝗼𝗴𝗿𝗮𝗺𝘀: • The 1990 Organic Foods Production Act (OFPA) provides structure to the USDA National Organic Program, offering some protection. • Changes in Chevron deference might impact USDA’s interpretation of National Organic Standards Board (NOSB) recommendations and increase legal challenges. • Potential for increased lawsuits and stagnation in rulemaking; the Continuous Improvement and Accountability in Organic Standards Act (CIAO) aims to provide clearer mandates for updating standards. 𝗙𝗲𝗱𝗲𝗿𝗮𝗹 𝗥𝘂𝗹𝗲𝗺𝗮𝗸𝗶𝗻𝗴 𝗮𝗻𝗱 𝗜𝗻𝗱𝘂𝘀𝘁𝗿𝘆 𝗥𝗲𝘀𝗽𝗼𝗻𝘀𝗲: • Without Chevron deference, legislation will need to be more specific, requiring industry experts to help Congress fill knowledge gaps. • The Organic Trade Association (OTA) encourages members to engage and collaborate on crafting effective legislation. The USDA National Organic Program (Agricultural Marketing Service) has released a major update to its "NOP Handbook: Guidance & Instructions for Accredited Certifying Agents & Certified Operations." This is the first major update in many years, and we have been eagerly waiting for it! The NOP Handbook documents have been updated or archived to reflect new regulations, such as the Strengthening Organic Enforcement rule. Additionally, general education resources have been relocated to more relevant locations on NOP’s website and in the Organic Integrity Learning Center.
