Exciting to see salmon making their way up the San Joaquin River. The attached video shows fall run chinook salmon at the Mendota Dam fish ladder. The San Joaquin River Restoration Program is focused on spring run chinook, but includes fall run as a fishery that is expected to benefit from the program’s efforts. The Restoration Program is a result of a settlement between parties after several organizations (including The Bay Institute) filed a lawsuit under Fish and Game Code 5937. This 1937 law is based on the Public Trust Doctrine that is part the original constitution of California when we became a State. In other words, the Public Trust is the most senior water right. This law demands that dam operators maintain existing fisheries in “good condition“ below their dam. Importantly, this law pertains to all dams on the San Joaquin River, not just Friant. This law is slowly being applied to California rivers as organizations put together resources to force agencies to follow this historic law. We have a long way to go, but I’m optimistic we will see more people join our efforts to recover the public’s right to healthy rivers.
