It is extraordinary to hear a sitting MP stand up and assert that international law is subservient and gives way to the sovereignty of Parliament. How could anyone think that could possibly be true? What is true is that our courts in the UK are guardians of our law in the UK - so insofar as international law is not made part of our law (or if Parliament makes law that is in clear violation of international law), it is generally not the role of our courts to secure the respect for our international obligations that the country, including our Parliament, may seek to abuse. But whatever the incapacity of UK courts to uphold this country's legal obligations, those obligations cannot be overridden by the UK's Parliament anymore than any other country (its executive, lawmakers or courts) can override the international law obligations it shares with the UK. Rather than perpetuating false and foolish notions about their own powers (to override law, truth and proper legal process), MPs debating the Safety of Rwanda Bill would do well, then, to consider what the Constitution Committee did say on these matters (their report at link below). More than that, they would properly and usefully represent us all if they would finally take responsibility for holding the Government to account for an utterly ruinous policy of more than 3 years. And demanding its end - rather than yet again permitting the Government to have its Bill (to follow its last two) to pursue this policy still further and to even more widespread human, financial, legal and moral harm. https://lnkd.in/ebzHfmxc

Foreign Policy in CARICOM: Principled or Transactional - There has been concern in Jamaica about whether the Government’s foreign policy is principled or transactional and this discussion extends to CARICOM and its member states. What kind of foreign policy is practiced in CARICOM? It could be said that for many of the Member States, it is transactional being largely about economic development gains and winning elections. But, for small, middle income, island developing states, without power and influence, the rule of international law and multilateralism are important in foreign policy, thus the foreign policy practiced should be “Principled pragmatism”. The rule of international law is important as is gaining economic development benefits for advancing the country and raising standards of living. The strategy utilized is critical and must come from sound knowledge of the issues, thorough examination looking at pros and cons, consultations, clarity on national interests, and adherence to principles of national importance. The draft law clearly states that the government agrees to regulate that Vietnamese individuals settled abroad with Vietnamese citizenship will have all the land-related rights as citizens residing within the country. The Ministry of Natural Resources and Environment has drafted certain provisions to amend the Land Law, which the government has submitted to the National Assembly’s Standing Committee.
