On 26 April 2023, Bayside Council endorsed a draft Planning Proposal (PP) to make amendments to the Bayside Local Environmental Plan 2021 to land zoned R3 Medium Density Residential to facilitate development of new homes. This proposal seeks to: (1) Increase the maximum Floor Space Ratio (FSR) from 0.6:1 to 0.7:1, and (2) Introduce a new provision stating that Clause 4.1 will not apply to the subdivision of land in Zone R3 on which the erection of Multi-Dwelling Housing or attached dwelling have been approved or proposed. This proposal is part of Council’s efforts to meet the Department of Planning, Housing and Infrastructure’s requirement to update housing controls in line with the Local Housing Strategy (LHS). The proposed amendments are expected to deliver capacity for hundreds of new dwellings within the Bayside LGA and contributes to the delivery of State and Commonwealth Government commitments under the National Housing Accord. The Government recently made some changes to the planning system with the aim of increasing the number of new houses being built. Despite these efforts, the latest figures indicate significant challenges ahead. Data from the Energy Performance Certificate (EPC) reveals that 229,700 new homes were completed in the twelve months leading up to June 2024. This number has remained relatively unchanged at around 230,000 since the end of 2023. The overall trend in residential development is not promising. According to the ONS construction output measure, there was a decrease of more than 15% compared to 2019’s level in May 2024. Additionally, the number of new housing starts is dropping at a concerning rate. The National House-Building Council (NHBC) reports that annualised starts have fallen by 55% from Q2 2023 to Q2 2024. New regulation proposed for Additional Residential Units will create province wide standards for FSI, max. lot coverage, minimum lot size, angular plane and building separation on lots where ARUs are permitted under the post Bill 23 rules. On September 23, the government posted the details of the proposed new regulation on the ERO for comment until Oct. 23. The proposed standards will over-ride zoning by-law requirements for parcels with ARUs for: - FSI - Minimum lot size - angular planes In addition a maximum lot coverage of 45% is proposed, along with a maximum building distance separation of 4 metres.
