Here we are once again legislating knee-jerk reactions from politicians who are clueless about how technology works…and then one person addresses the real problem (our laws around digital privacy, advertising, data sharing, usage, and age constraints) yet gets no traction because his colleagues are either in an opposing lobby’s pocket or just dumb Luddites eager to demonize anything to take the focus off themselves and their lack of experience in matters that affect millions. TikTok isn’t the issue - our LAWS are. You can not protect a nation against an online threat of any kind without creating the legal system to do so internally and we are woefully inadequate at doing this. Imagine if we had no laws for example to address car theft, for example. Exactly how do we punish people for stealing them? If we were to go by the ban TikTok model, we would punish the manufacturers for making them. Does that make any sense? No. Of course, it doesn’t.

In data privacy class actions, plaintiffs often allege that their PII was shared without adequate disclosure especially where the defendants use #adtech on their websites or within their services. There are literally hundreds of cases alleging that Meta Pixel, Google Analytics, and other similar software embedded in defendants’ websites secretly captured plaintiffs’ web browsing data and sent it to Meta, Google, and other online advertising agencies. A recent case in Pennsylvania, Smart, et al. v. Main Line Health, Inc., No. 22-CV-5239, 2024 WL 2943760 (E.D. Pa. June 10, 2024) shows a path to relief from these actions for defendants. Judge Kai Scott dismissed the case in its entirety finding that the plaintiffs failed to allege with enough specificity the actual personal information that was disclosed and therefore that the Electronic Communications Privacy Act (ECPA), negligence, and invasion of privacy claims could not continue. This case is positive for users of AdTech - i.e., many, many companies - as it requires plaintiffs to specifically plead what PII or PHI was disclosed in addition to plausibly pleading criminal or tortious intent and an interception. NEWS FLASH: Nebraska Passes Opt-Out Privacy Bill Lawmakers in Nebraska have passed a #privacybill that would require companies to allow state residents to opt out of common forms of online #adtargeting. If enacted, the Data Privacy Act (LB 1074) would also obligate businesses to honor universal opt-out tools -- such as opt-out signals that consumers can send through their browsers -- but only if the companies honor those signals in other states. https://lnkd.in/gSSaKMmS

The latest update to Google's Privacy & messaging user message involves changes to consent revocability, reflecting the advertising industry's ongoing adaptation to privacy expectations across Europe. In this update, Google has removed references to privacy policies as a place to withdraw consent and clarified that the consent revocation link at the bottom of the page should now read "Privacy and cookie settings." Google has made this change to ensure consistent transparency and user control over their data. Despite this update, website owners can still include a consent revocation link on their data, cookie, or privacy policy pages if they prefer. Google AdSense also automatically adds a required European regulations message revocation link to sites where European regulations messages are displayed. #PPC #SEA #Ads #GoogleAds

As you likely already know, Google has been getting itself on the same page with the UK to continue with removing the cookie from existing. While digital privacy has been growing in popularity for so long, there is always going to be those who disagree with the disappearance of third-party cookies, because they believe it would devastate ads. While there are always going to be organizations that think like this, it's important to remember that no matter what happens, things must be done morally.
